양육권자의 거소지 이전과 면접교섭권 침해

초록
면접교섭권을 혈연의 접촉권이라는 기본권이 법적으로 구체화된 권리로 보아 일응 양육권과는 별개의 개념으로 파악하고, 개념적으 로는 양육과 연관된 자의 복리를 면접교섭권의 적극적인 운영원리 가 아니라 소극적인 제한원리로 파악하였다. 그럼으로써 면접교섭권 의 의무성보다는 권리성을 다시 확인하고, 부모와 자의 면접교섭권 을 통일적으로 설명할 수 있으며, 자의 복리가 개입하는 지점을 이 미 성립하고 있는 면접교섭권의 제한 사유로 명확하게 자리잡게 할 수 있다. 면접교섭권이 원활하게 행사되고 있어 자녀의 복리에 기여 하고 있는 이상적인 경우를 도출할 수 있고, 이 경우에는 양육권자 의 해외 이주 등 거소지 변경이 면접교섭권을 침해하게 된다는 결 론을 도출할 수 있다. 이 때 설령 거소지 이전으로 자녀의 복리가 증진되는 경우라고 하더라도 그것만으로 기존의 면접교섭권을 배제 할 수 있다는 결론을 내릴 수는 없을 것이다. 기존에 진행되고 있는 면접교섭을 무시하고 거소지를 무단으로 해외 이전하는 것은 명백 한 면접교섭권 침해가 되고 이 때 자녀에 대한 인도청구가 가능하 다고 할 것이다. 다만 현실적으로 기왕에 진행되고 있는 면접교섭이 자녀의 복리를 일정부분 저해하는 경우에는 그 정도가 면접교섭을 배제 내지 제한시킬 수 있는 정도에 이르는 것은 아니라고 하더라 도 그와 같은 사정을 감안하여 해외 이주라는 사정변경에 따라 면 접교섭을 제한하는 것이 바람직할 것이라고 하겠다.
Abstract
The right of access is the human natural right to contact with parents and children. As to the right of access, child's best interest is not the establishing concept but the principle to determine restriction. Then we assure that the right of access is not the obligation but right. In that point we could successfully explain the right of access not only as to parents but also as to children. When visitings go on successfully and peacefully, moving to foreign country might infringe non-custodial parent's right of access. If custodial parent dare to move or relocate without non-custodial parent's consent or court's decision, custodial parent obviously infringe the right of access. But in real world, there are many failure of visiting which aggravates the relationship between custodial parent and child resulting in counter-productive situation as to the child's welfare. Even if such failure does not make the reason to restrict or remove the right of access, custodial parent's move could be allowed.
