중국의 지적재산권침해와 기업의 대응방안에 관한 연구 -특허권과 상표권침해를 중심으로

As China’s WTO accession promises greater market access and a more predictable commercial environment, new entrants will be encouraged to enter China’s market. Though companies are finding commercial opportunities in China, there are many potential pitfalls companies should be aware of, including issues related to the protection of intellectual property. Since joining the WTO, China has strengthened its legal framework and amended its Intellectual Property Rights and related laws and regulations to comply with the WTO Agreement(TRIPs). Despite stronger statutory protection, China continues to be a haven for counterfeiters and pirates. This paper indicates that China's current Intellectual Property Rights law systems and infringement cases are focused on patents and trademarks. In conclusion, this paper provides practical countermeasures for business on infringement of China's intellectual property rights.
