초록
범죄행위 및 형사정책에 관한 현대 법경제학은 합리적 선택이론에 기초한 합리적 개인을 범죄행위에 있어서의 행위 및 판단의 주체로 상정하고 있다. 이 논문은 최근에 많은 연구결과가 축적된 행태법경제학의 결과에 기초하여, 잠재적 범죄자를 포함한 개인의 행동양태가 합리적이지 않을 가능성을 명시적으로 고려할 경우의 범죄행위에 관한 법경제학적 분석을 시도한다. 합리적 선택이론에 기초한 이론과 달리, 행태법경제학에서는 개인이 의사결정을 함에 있어서 체계적인 편향을 보이고 오류를 범하는 존재인 것으로 본다. 다른 한편, 행복에 대하여 지난 10여 년 동안에 새로운 심리학 및 경제학적 접근이 시도되어 왔다. 행복학의 연구결과에는 형사법의 집행과 관련해서도 유용한 시사점을 주는 것들이 포함되어 있다. 이와 같은 근래의 행태법경제학 및 행복학의 연구결과에 기초하여 생각해 보면 형사정책의 범죄행위 억제기능을 강조해 온 기존의 법경제학 분석틀에 일정부분의 수정을 하는 것은 불가피해 보인다. 잠재적 범죄자가 가진 법에 관한 지식과 정보의 한계, 합리적 판단의 가능성 측면에서의 한계, 그리고 범죄행위로 인한 기대편익과 그로 인한 기대비용 사이의 관계에 대한 인식에 있어서의 한계 등으로 범주를 나누어서 기존의 이론틀을 재검토할 필요가 있다. 또한, 법집행당국과 잠재적 피해자의 행위양식에 대해서도 새로이 생각해 볼 여지가 있다.
Abstract
Departing from the conventional model based on the rational choice theory, recent studies of law and economics take into account the possibility that an individual's behavioral patterns may not always be rational. Thus, in behavioral law and economics, analyzing systematic biases and errors that individuals show in their decision-making process becomes an important factor to consider. Also, in recent years, active research has been conducted regarding happiness or hedonics in the field of psychology and economics. Drawing on these research results from related areas, this article examines what implications could be garnered for the law and economic analysis of crimes and criminal law enforcement. It is argued that the deterrent power of criminal law enforcement may not be as strong as the conventional model suggests. More generally, it is argued that there is a need to re-examine existing theories on criminal law and policy based on the findings that there are limits to: a potential criminal offender’s knowledge about the law; individuals’ ability to make rational decisions; and individuals’ capability to calculate expected cost from committing a crime.
