증권거래법 판례의 변화와 전망 - 자본시장법의 제정과 관련하여 -

Financial Investment Services and Capital Markets Act(Capital Markets Act) was enacted on Aug. 2007, and entered into force on Feb. 2009. The Securities and Exchanges Act(SEA) was absorbed into it. Capital Markets Act is carrying on the important articles of the SEA with making some changes. Therefore, old securities cases are useful to interpret the articles of Capital Markets Act. This paper aims to review and analyses the major or leading securities cases in SEA. The topics was divided into several parts as follow : the enactment of Capital Markets Act, the definition of security and the formation of selling on commission, the regulation of financial investment business, the regulation of issues and circulation of securities, the civil liability and assessment of damages arising from illegal auditing, and the regulation of unfair transaction. In conclusion, I will say that the old securities cases will have important effects on the interpretation and application of Capital Markets Act.
