계약 및 법률행위법의 개정방향 -법무부 민법개정위원회 제1분과위원회의 개정작업을 중심으로-

2009.2.4., Ministry of Justice organized Civil Law Amendment Commission (hereafter “Commission") and delegated authority of making a revised Bill of the Civil Law to the commission. The commission consists of 5 sub-committee. This paper aims to report the work of the sub-committee No.1 which deals juridical act including contract and agency (hereafter “sub-committee"). The sub-committee proposes the amendment of Articles. 104, 137, 140 and is now preparing the amendment of Articles. 109, 110 etc. as well as new provisions on the interpretation of the juridical act and the abuse of agency. Moreover, the sub-committee reviews the structure of the provisions on the juridical act and on the agency. The members of the sub-committee try to keep the equilibrium between the contradictory principles and suggest the reasonable solution to settle the conflict of interests.
