한국의 치안인력과 범죄율에 관한 소고

초록
본고는 경찰력을 포함한 치안인력의 강화가 범죄억제에 미칠 수 있는 영향에 대해 기존의국내 선행연구결과들의 부정적 결론과는 달리 긍정적인 차원에서 재고해 보는 것을 목적으로하였다. 그 효과를 긍정적으로 재고할 수 있게 된 근거는 선행연구에서 사용했던 공식범죄통계자료가 아니라 특정 기간 동안 공식범죄통계상의 증가추세와는 달리 감소추세를 보여 왔던 범죄피해조사상의 추세이다. 즉 공식범죄통계상의 증가추세에도 불구하고 실제 범죄가 감소추세로나타나는 것이 논리적ㆍ현실적으로도 가능한 것이라는 최근의 논의를 수용한 연구이다. 그리하여 같은 기간 이루어진 치안인력의 확대가 범죄 증가에 비례하는 것이 아니라 오히려 범죄 감소에비례한다고 판단한다. 이러한 판단은 치안인력의 강화가 한편으로는 범죄 인지를 증가시켜 공식적으로 기록되는 범죄기록량을 증가시키면서 동시에 실제 범죄는 감소시키는 이중효과를 발휘했을 것이란 추정으로 귀결된다. 단, 이 때 치안인력 강화의 범죄억제 효과는 제3변인의 개입가능성 등을 고려할 때 여전히 분명치 않은 측면을 가지고 있다고 볼 수는 있다. 그럼에도 불구하고 그와 같은 판단은 치안인력의 강화가 범죄억제에 미칠 수 있는 영향을 사실상 봉쇄해버렸던국내의 기존 선행연구결과들을 감안할 때, 치안인력의 강화가 범죄억제에 긍정적인 영향을 미칠수 있는 가능성을 열어주기에는 충분하다고 본다.
Abstract
This paper aims to rethink over negative results of existing all (and not many at the same time) studies about the criminal deterrent effects of police in Korea. The basis of such rethink is the results of criminal victimization survey in Korea. It is different from the method of analysis of existing Korean study on the same subject. Their ground of negative results of previous studies about the deterrent effects of police was the official crime statistics data without exception. But for recent decade or more, the trends of official statistics crime rates in Korea have turned out to be quite different from the trends of victimization survey data in Korea. While the official statistics showed increasing rates since early 1990s to the mid of 2000s, the victimization data indicated rather decreasing rates. According to recent study on which are the more accurate reflection of reality,the probability that the trends of victimization survey data are the truth is higher than that of official statistics. Accepting such recent study, this paper suppose that the increase of police power have corelation to the decrease of crime rate, not the increase of crime rate, differently from the previous studies on the same subject. Within such supposition, it is possible to think that the increase of police power bring about the increase of official criminal statistics crime rate by means of improving police's ability of detection of hidden crime, simultaneously the increase of police power contribute to the decrease or deterrence of real crime. However, there still remains some questions about the pure deterrent effects of police, because of problems of controlling the third variables.
