성경적 관점에서 본 토지 취득과 소유 그리고 분배와 활용에 관한 연구

이 논문의 주제는 신구약 성경적 관점에서 출발한다. 이 주제에 대한 연구는 오늘의 시대적 상황에 검토되어야 할 필요성이 있다. 토지 재산은 인간 삶의 터전이며, 근거이다. 하나님은 땅을 창조하시고 인간에게 취득, 소유, 분배 그리고 활용하도록 허락하셨다. 따라서 인간은 그 땅을 보존하고 개발하고 그리고 사용할 권리와 의무를 가지고 있다. 그러나 인간이 그 땅의 절대적 소유자는 아니다. 하나님께서 땅의 소유, 분배 그리고 사용을 허락 하신 목적은 개인의 유익과 독점이 아니라 인류 공동체의 번영과 행복과 사회복지를 위하는 데 있다. 이 목적의 실천을 위해 하나님께서 법적인 제도를 허락하셨다. 그것이 안식년과 희년 제도이다. 비록 각자의 경제적 상황에 따라 토지 재산을 팔거나 구매할 수 있도록 허락되었지만 희년에는 땅의 보유권이 법에 따라 개인과 가족에게로 돌아간다. 오늘날 일부 그리스도인들은 토지의 평등한 분배와 공공 임대제를 주장한다. 그러나 현재의 경제적 그리고 법적 제도의 틀 안에서는 실제적으로 불가능한 것으로 생각한다. 토지 공개념과 사유제의 폐지는 성경적인 것처럼 보이나 실제로 토지의 사유권은 성경적이다. 물론 토지의 개인 소유권은 절대적이라는 것을 의미하는 것이 아니라 청지기직의 권리일 뿐이다. 이러한 성경적 원리와 교훈에 기초하여 기독교 윤리는 무엇을 말해야 할 것인가?땅의 취득, 소유, 분배 그리고 활용에 대한 권리는 인간에 허락된 것이나 안식년과 희년에 자연적 소출을 통해 얻은 것들은 가난한 이웃들과 함께 나누도록 하는 사회적 책임성을 부여하고 있다. 또한 성경의 교훈은 법적 제도나 권력을 이용하여 재산을 독점하고 사유화 하려는 것을 예방하려는 목적이 있다. 그럼에도 성경의 원리와 교훈은 오늘날 국가의 경제와 토지 제도에 실제로 적용하는 엘에는 많은 연구가 필요하다. 오늘날 우리 사회 안에는 가옥이나 토지 재산에 대한 양극화 현상은 여전하다. 그렇다면 한국교회가 찾아야 할 대안이 무엇인가? 사회와 교회 공동체 안에서 경제정의를 실천하는 것이며, 인간은 항상 자신이 청지기임을 명심하고 주어진 물질재산으로 나의 가정과 이웃을 돌보는 일에 헌신해야 한다.
Abstract
his paper starts in some respects from the biblical perspective on two testaments. However, if we do not explore what the Bible says about this issue now, there will be no opportunity to do so. The land is basic foundation of human property and life. God granted it to man and permitted to acquisite, posses, distribute and use for himself. Man has a right and duty to preserve, develope and use it, but is not absolute owner of the land. God made the fundamental legal systems. They are sabbatical and jubilee years. Even though the land is of God, it was permitted to sell and buy according to each man's economic situation. But the ownership of land returns to each man or each family according to Jubilee law. Today some christians insist equal distribution and public lease of the land. It is proper suggestion, but actually impossible to apply to the present economic and legal systems. What do Christian ethics say? It must present some biblical teachings and principles from the biblical perspective. First, in the creation law, the right of acquisition, possession, distribution and use of land was permitted to man by God. Second, the sabbatical and Jubilee laws are for the aim to make land rest and to produce much fruits. Third, the purpose of equal distribution of the land in the Bible is to prohibit the privatization and monopolization of property for exploitation by legal systems and authorities. Fourth, biblical principles of property acquisition, possession, distribution and use do not fit to the contemporary national economic and land systems. What is the alternative that korean churches search for? It should be the practice of economic justice in the society and the church community. Man does remember himself God' steward before him.
