Taking Integrity Seriously: Recent Trend in Jurisprudence of the Korean Supreme Court

The essence of Dworkin’s legal philosophy is that law is and should be based on integrity. According to law as integrity, propositions of law are true if they figure in or follow from principles of justice, fairness and procedural due process that provide the best constructive interpretation of the community’s legal practice. Integrity in legislation means that legislators should try to preserve coherence in principles. Integrity in adjudication means that judges responsible for establishing and declaring “what law is in this case” should try to interpret the statute and case law coherently. Especially in statutory interpretation, the judge should treat the statutes with integrity and must give them the meaning that show its political history and legal practices of the community in best light. My thesis is that the Korean Supreme Court has changed its jurisprudence in important respects during recent periods and that the turn can be summarized as ‘taking integrity seriously’. By analyzing recent decisions of the Korean Supreme Court through the lens of Ronald Dworkin’s theory, I will try to demonstrate my thesis.
