디지털 교과서 도입에 대한 법률적 문제 －저작권법을 중심으로－

iPad가 출시되고 스마트폰 사용자가 늘어나면서 e-Book은 출판업계뿐만 아니라 IT업계 나아가 전사회의 최대 관심사로 떠오르고 있다. e-Book은 기존의 서책형 서적에 비해 많은 장점을 가지는데, 최근 교과서의 디지털화가 추진되고 있는 것은 같은 맥락에서 당연한 시대적 흐름에 편승하는 것으로 보인다. 본고에서는 디지털교과서 도입 자체에 대한 찬반보다는 도입시 문제점을 최소화하고 효과를 극대화할 수 있는 방안을 모색하기 위한 목적으로 연구되었다. 도입 초기에는 단말기 수급, 학생들의 적응 문제, 교육 방법의 교육, 관련 인력 양성 등도 문제되겠지만, 디지털교과서의 성패는 결국 콘텐츠에서 갈릴 것이다. 그리고 이는 저작권법의 영역이다. 대부분의 국가에서는 교육을 위해 저작권자의 권리를 제한하고 있다. 우리 역시 마찬가지로 저작권법 제25조 제1항에는 교과서를 위한 명문의 규정도 마련하였다. 하지만 이는 서책형을 염두에 둔 것으로 디지털교과서의 효과적 활용을 위해서는 부족한 점이 많다. 그럼에도 디지털 교과서가 추진되는 과정에서 상대적으로 저작권문제가 소홀하게 다루어지고 있는 점은 커다란 우려를 자아낸다. 플랫폼 등의 기술적 요소나 교육학적인 접근과 더불어 법제도적으로 저작권적인 연구가 충분히 선행되어야 디지털교과서의 성공적 도입을 기대할 수 있을 것이다. 이에 디지털 교과서와 교과용 도서의 개념, 게재와 전송의 구분, 저작인접권의 보호, 인터넷 자원의 충분한 활용, 현 보상금 규정의 한계 등을 중심으로 현행법의 문제점을 지적하고 향후 개선 방향을 제언하였다.
Abstract
E-books has recently become the main interest not only in the publishing business but also in the society. Thanks to IT technology, they are more convenient in various ways than paper books. Therefore, it is the demanding of the times to push ahead with the adoption of a digital textbook. This paper studies the ways how to maximize the effectiveness and minimize the problem when digital textbooks are adopted, not discussing the adoption itself. The success or failure of a digital textbook depends on content, which belongs to copyright's domain. Like other countries, the restrictions on copyright for the education is prescribed by law in Korea. Particularly, Article 25.1 of Copyright Act is for a textbook. However, this is unsatisfactory for the effective use of a digital textbook due to the fact that a paper book was kept in mind when the law was legislated. This paper points out the problems of the current law, mainly focusing on the clause Article 25.1, such as whether a textbook is relevant or not, the permission of transmission, the protection of neighboring right, the limitations of an indemnity clause, etc., and suggests the suitable direction for a future improvement.
