현행 도시정비법상 재개발·재건축제도의 개선방안에 관한 연구

재건축사업을 가로막던 9개의 규제 가운데 분양가 상한제 적용을 제외한 8개 규제는 완화 또는 철폐되면서 재건축사업이 활력을 회복할 것으로 전망된다. 그러나 이러한 이명박 정부의 규제 완화노력도 살펴보면 노무현 정부에서 추진했던 많은 규제를 부분적으로 철폐하여 왜곡된 재건축시장을 바로잡는 수준이지 재건축 사업의 순기능을 적극적으로 살리고 발휘할 수 있는 종합적인 활성화대책과는 거리가 있다. 따라서 향후 정부는 재건축사업의 순기능을 제고하면서도 도시정비법의 취지인 재건축 사업의 부작용을 해소하기 위한 추가적 대책을 마련해야 한다. 우선 도시정비 및 재정비사업에서 공공의 기능과 역할을 강조하지 않을 수는 없다. 그러나 공공의 역할을 강조한다고 해서 노무현 정부와 같은 공공이 시장의 모든 것을 좌지우지하는 접근보다는 현실적으로 공공의 능력이 도시정비 및 재정비사업에서 담당해야할규모에 비해 매우 제한되어 있다는 점을 우선 자각해야 한다. 실제로 공공의 제한된 재원 및 전문인력으로 인해 도시정비사업 초기단계에서 반드시 필요한 지구지정을 위한 기본계획의 수립이 사실상 주민들에 의해 이루어지고 있다. 반면 주민들의 부족한 전문성과 자금조달을 지원해야 할 지자체의 역할은 거의 이루어지지 않고 있는 실정이다. 따라서 선택과 집중이라는 전략에 입각하여 제한된 공공의 행정력을 규제로 낭비하지 말고, 조력자이자 지원자의 역할을 위해 활용하면서 민간의 자금과 전문성을 활용하는 차원에서의 추가적인 활성화대책이 제시되어야 할 것이다. 또한, 도시 및 주거환경정비법 제정의 취지를 살리면서도 도시정비사업의 순기능을 훼손하지 않기 위해 제도개선의 방향을 ‘재개발·재건축사업의 투명화와 활성화를 달성하는 한편 도시 내 토지이용 효율 증대 및 소득수준 향상에 대응한 주택재고 수준의 질적 향상 도모’로 설정하였다. 이와 같은 도시정비사업 제도의 개선방안으로는 ① 도시정비사업 활성화 지원기금(가칭) 설치 ② 정비사업전문관리업자의 역할 강화 ③ 민간과 공공의 공정한 사업참여 여건 조성 ④ 도시정비사업 공동시행제도 개선 ⑤ 주민제안 제도화 ⑥ 조합설립 동의 요건 완화 ⑦재건축사업 결의 요건 완화 등을 법적 검토와 함께 제시하였다.
Abstract
In the 1960s, Korea began to push forward with development plans involving intensive industrialization and urbanization. Immense gravitation of industry and population created overcrowded urban areas and caused serious housing problems especially in areas such as Seoul where the land was limited but the population increased at an exponential rate. Before long, the demand for the change or land use within the restricted urban area grew dramatically and redevelopment plans of existing urban blocks and land were launched. As a results, the urban redevelopment projects in Korea already in the 1970s and have constantly been in progress despite a few changes in its policy. The goal of these projects is to suit the demands of new urban environments by changing or intensifying the land use in civic areas where the surroundings have been diapidated or the land demand cannot be met due to reckless block plans. This research covers an overview on the general concepts, processes and current trends of urban redevelopment plans and some progress reports of current major projects, followed by an analysis of the problems and future visions of urban redevelopment plans
