장애아동 관련 국제협약과 국내법 분석을 통한 발전방안 연구: 국제장애인권리협약과 국내 장애아동 관련법 분석을 중심으로

본 연구는 장애아동의 정책적 보편성과 특수성에 기반하여 국제장애인권리협약과 관련 국내법들에 대한 독립적 가치는 물론 관련성 하에서의 의의를 제도분석차원에서 접근하여 분석함으로써 장애아동정책 정립의 시사점을 얻고자 하였다. 이에 장애아동정책과 관련한 국내의 장애인관련법과 아동관련법 모두를 함께 분석하였는데, 이중 보다 직접적인 관련성을 갖는 제도(법)로 각각 6개씩을 선별하여 분석하고, 국제장애인권리협약은 협약 내 장애아동관련 조항 16개 영역․24개 조항을 중심으로 전체적인 맥락과 타 협약 혹은 국내법과의 관련성 하에서 분석하였다. 이에 국제장애인권리협약의 국내비준을 국내법에 대한 수동적 영향과 반응적 접근이라는 차원보다는 장애아동정책정립의 기준 혹은 준거로의 설정과 선응적 접근이라는 방향정립 차원에서, 그리고 그간 국제아동권리협약 등 기존 국제협약의 불성실 이행에 대한 반성이라는 측면에서 발전방안에 대해 논의하였다. 결론적으로, 우선 국제장애인권리협약의 전문 및 일반규칙, 분야별 영역에서 담아내고 있는 인권패러다임(독립된 인격체로서의 주체성의 인정, 능동적 권리의 수용), 사회관계적 모델(사회적 장애개념 포함), 최선의 이익실현관점, 가정통합적 접근과 수평적․수직적 통합접근의 적용을 국내법 정립의 기본 규범적 가치로 설정하고, 다음으로 주요 권리영역으로 설정한 생존권, 발달권, 보호권 등 각 영역의 의의를 고려하여 실천과제를 제시하였다.
Abstract
This study aimed at obtaining suggestions on the establishment of policies for children with disabilities by accessing and analyzing, in terms of systematic analysis, not only the independent values of International Convention on the Rights of Persons with Disabilities and related national law but also the significance of the relation between the convention and related national law based on the universality and speciality of policies for children with disabilities. To this end, the study analyzed the national law relating to people with disabilities and the national law relating to children both of which are associated with policies for children with disabilities. From each of the two national laws, six systems which are directly related to the convention were selected and analyzed. International Convention on the Rights of Persons with Disabilities was analyzed in terms of its overall context and its relation with other conventions and the national laws based on its 24 provisions in 16 areas related to children with disabilities. The study discussed the domestic approval of International Convention on the Rights of Persons with Disabilities in terms of the establishment of direction explained by the establishment of the standard for the establishment of policies for children with disabilities and proactive approach instead of passive influence and responsive approach on the national law. In addition, the study discussed the advancement of the domestic approval in terms of reflection over the incomplete fulfillment of existing international conventions including International Convention on the Rights of the Child. In conclusion, the application of human rights paradigm (acknowledging subjectivity as an independent personality, accepting an active right), social relationship model (including the concept of social disability), the perspective of realizing best benefits, integrated family approach and integrated vertical․horizontal approach contained in the preamble, general rules and each section of International Convention on the Rights of Persons with Disabilities were set as basic normative values for the establishment of the national law. Moreover, tasks that need to be practiced were presented in consideration of the meaning of each of key areas of rights including the right to exist, the right to development and the right to be protected.
