제2공화국 헌법상의 의원내각제

본 논문은 제2공화국 헌법상의 의원내각제에 대하여 다루었다. 제3차 개헌에 의하여 의원내각제로 권력구조가 변경되는 과정을 비교적 상세히 살펴보고, 제2공화국 헌법상의 의원내각제의 내용과 운용, 그리고 이에 대한 평가를 시도해 보았다. 우리 헌정사에서 약 9개월이라는 짧은 기간 동안 존재하였던 제2공화국 헌법상의 의원내각제는 권력구조의 개편을 포함하는 헌법개정의 문제에 있어서 시사하는 바가 적지 않다고 생각된다. 먼저 이승만 정부의 붕괴와 과도정부에서 제3차 개헌에 의한 제2공화국 헌법이 성립되는 과정을 살펴보았다. 극도로 혼란했던 당시의 정국을 해결할 수 있는 방도로 채택된 의원내각제로 헌법이 개정되는 과정을 살펴보았다. 그리고 제2공화국 헌법상의 의원내각제에 대하여 본격적으로 살펴보았다. 제2공화국 헌법상의 의원내각제의 본질적 구조와 특징을 살펴보고, 아울러 당시 우리나라의 의원내각제 권력구조에 대한 이해의 정도는 어떠했는지에 대하여도 알아보았다. 마지막으로 제2공화국 헌법상의 의원내각제의 운용과 함께 그 평가를 시도해 보았다. 영국형의 순수한 의원내각제를 선택했던 제2공화국 헌법상의 의원내각제가 실제로는 어떻게 운용되었는지, 그리고 왜 이 제도가 가진 가치를 느끼지도 못하고 혼란만을 거듭하다가 단명하고 말았는지에 대하여 평가해 보았다. 제2공화국 헌법상의 의원내각제는 4.19혁명 이후의 드높은 민의에 기초하여 탄생했지만 사회적 여건의 미성숙과 제도적 미비점 등의 원인으로 혼란 속에서 종말을 고했다. 그러나 이러한 의회민주주의의 미성숙이라는 과제는 오늘날에도 벗어나지 못했다고 생각한다. 그러한 의미에서 제2공화국 헌법상의 의원내각제의 성립과 운용은 우리에게 여러 가지 의미를 생각하게 한다.
Abstract
This study deals with the parliamentary cabinet system of the Constitution of the Second Republic of Korea. It closely examines the changing process of the power structure under the parliamentary cabinet system of the third constitutional amendment, and attempts to make an assesment about the substance and application of the Republic's parliamentary cabinet system. The government system of the Second Republic which lasted only for about nine months has great implications in terms of the matters of constitutional amendment including reorganization of power structure. Firstly, this research explores the process of the Second Republic's Constitution established by the third constitutional amendment during the period between the fall of Lee Sung-Mhan government and the subsequent interim government. It also investigates the process of reforming the Constitution into the parliament cabinet system taken as a measure of stabilizing the then political situation which were in complete chaos. In addition, it studies the fundamental structure and features of the cabinet system based on the Second Republic's Constitution as well as the degree of understanding about the power structure of the system in Korea at that time. Finally, it attempts to carry out an assessment of the parliament cabinet system and its actual application, shedding light on how the legal system, which adopted the pure parliamentary cabinet system of England, was operated in reality as well as why the system rarely lasted in confusion, with little recognition of the value the system had. The parliament cabinet system of the Second Republic came into the world along with the uprising will of the people after April 19 revolution but came to an end in confusion due to the immaturity of the social conditions and the weaknesses of the system and so on. However, it is claimed that the problems with such immaturity of parliamentary democracy have not been solved so far. In this light, the establishment and application of the parliamentary cabinet system based on the Constitution of the Second Republic leads us to ponder its various implications.
