초록
소크라테스식(문답식) 교수법을 실천하는데 있어 아직 어려운 점이 많은 것이 사실이다. 소크라테스식 대화법의 구조는 어느 정도 밝혀져 있는 듯한데, 소크라테스식 교수법을 실천하고 있다는 예는 쉽게 찾기 어렵다. 소크라테스식 대화법에 대한 지금까지의 연구는 논박형 대화가 주를 이루는 플라톤의 초기 대화편에 집중되었다. 또한 종래 연구는 논박형 문답의 구조를 해부해 보였을 뿐, 산파형 문답을 포괄해서 질문의 유형이나 원리가 무엇인지, 질문들을 조직하는 방식이나 맥락은 어떠한지에 대해서는 거의 관심을 가지지 않았다. 이 글에서는 초기 대화편에 국한하지 않고 여러 전거들을 기초로 소크라테스 대화법을 추적해 보았다. 소크라테스식 대화법을 실천할 수 있도록 질문의 유형들을 5가지로 구분해보고 이를 분석하였으며, 또 이러한 질문들의 맥락과 조직원리, 전개방법을 살펴보았다. 소크라테스식 대화법은 문답을 통한 앎의 음미라 할 수 있는데, 이 앎의 음미라는 것은 결국 앎을 붙잡고 드러내려 한 말을 문답을 통해 다듬는 것이라는 점, 이러한 목적이 달성되려면 대화상대방은 법정에서 변론하듯, 또는 연설하듯이 대답하는 것이 아니라 묻는 질문에 짧게 예, 아니오로 답하여야 하며, 스스로 숙고한 바를 솔직하게 답하여야 하고, 논박당하는 점에 대해 수용적 자세를 취하여야 하며, 사례제시형 논증으로 대답하는 것은 허용되지 않는다는 등의 문답규칙을 설명하였다. 아울러 질문자는 문답과정에서 상대방에 어떤 태도를 취하여야 하는지에 대해서도 살펴보았다.
Abstract
Socratic method as Elenchus is well-known, but not widespread for practicing as ordinary and basic method in legal education. In fact we seem to have some kinds of knowledges of socratic method, but it’s not strong and enough to lead our practice, that is the reason and apparent weak loophole in researches so far. This article aims to investigate and reveal the truth of the basic idea of questioning and answering, as it were, examining knowledges by Socrates, and introduce several types of questioning and the ways how to organize questionings through Plato’s Dialogues and other reliable authorities. Socratic method requests interlocutor to define ideas of whatever he knows in words, because every knowledge, as it is a knowledge, definitely gets expressions in human languages. But the problem is that every kinds of human languages is unsatisfactory one to convey and reveal the truth wholly, because it always gets infections of human imperfectness, falls into corruptions to lead false judgements, acts. So to get pure knowledge, we need examine knowledges, that means examining linguistic expression of knowledge, ‘dialogue(dialectics)’. And some rules of the interrogatory method, Socrates stressed, to achieve aims of dialogues are classified and given proper explanations in this article.
