국민참여재판의 시행성과와 향후과제

초록
본 글은 국민참여재판이 시행된 지 2년 반 정도 경과한 시점에서 국민참여재판의 시행성과를살펴보고 향후 과제를 제시해보고자 하는데 그 목적이 있다. 다만 국민참여재판제도의 의의및 도입배경 등에 비추어 헌법적 측면에서의 논의와 헌법적 근거에 따른 배심원 평결의 효력재구성 등에 대한 논의가 제도 정착의 향방에 본질적인 문제라고 보아 이 문제에 중점을 두고자하였다. 현행 국민참여재판제도에 대한 헌법적 논의 부족과 이에 따른 시범시행이라는 타협으로인하여 배심제적 요소에 참심제의 요소를 가미한 형태라는 특성을 갖는다. 이러한 특성 때문에국민참여재판은 그 시행과정에서 적지 않은 문제점을 드러내고 있다. 먼저 원칙적으로 국민참여재판제도는 현행 헌법상 법관에 의한 재판을 받을 권리에 반하지 않는다. 다만 배심원이 양형판단에까지 관여할 것인가 하는 문제는 배심제도를 채택할 것인가 참심제도를 채택할 것인가에따라서 결정되어야 할 것이다. 그 어느 제도를 채택하든 배심원 평결에 대하여는 기속적 효력을인정하도록 해야 한다. 그 다음으로 대상사건의 확대, 대상사건의 필요적 국민참여재판 등을기본으로 하는 제도정착화 방안이 마련되어야 한다. 물론 제도정착에 있어서 가장 기본적인것은 관련 법조인의 인식전환과 사법부담에 대한 정확한 진단과 평가, 그리고 제도에 대한 국민이해 제고 등이며, 이에 대한 교육·홍보가 필요하다. 향후 재판 진행 과정에서 드러나는 배심원선정절차상 문제, 공판단계에서의 증인 및 피고인신문·증거조사상 문제, 그리고 항소 문제등에 대한 진단과 구체적인 대안모색을 통하여 완성된 형태의 국민참여재판제도 정착에 토대가되기를 기대한다.
Abstract
The article reviews the results of judicial citizens' participation system which enforces this system during two years and tasks in the future. Moreover, the article focuses the discussion of constitution aspect and reconstruction of effect of juries's verdict based on the constitutional grounds according to background of adoptian of judicial citizens' participation system. Currently, Judicial citizens' participation system has lack of the consideration of constitutional discussion and make compromise based on the jury system with lay judge system. For the above features, the judicial citizens' participation system contains many problems at the beginning of enforcement. First, judicial citizens' participation system does not violate against right to trial by judge under the Constitution. But,if the judicial citizens' participation system involves the sentencing, it should be determined whether the judicial citizens' participation system takes Jury System or Lay Judge. No matter what takes, Juries's verdicts must have the legal binding power. Second, it is important that the extension of Judicial Citizens's participation system cases and mandatory Judicial Citizens' participation system for the settlement of Judicial Citizens' participation system. For the institutionalization of Judicial citizens' participation system, it needs change of lawyer's understanding of Judicial citizens's participation system, accurate analysis and assesment of judicial burden, people's understanding and advertising or education of Judicial citizens's participation system The tasks in the future should be consider Jury selection problems, examination of witness and the accused, evidence discoveries problem, evaluation of appeal system and specific other alternative seeking for perfect institutionalization intercourse of trial
