중국의 치명상표(馳名商標) 인정방식과 기준에 관한 연구

Well-known mark는 높은 인지도를 가지고 있어 수요자에게 미치는 파급효과가 크기 때문에 국제협약에서 특별한 보호규정을 두고 있다. 그러나 통일된 개념이나 기준이 없기 때문에 각 국가에서 자국의 특색에 맞게 보호제도를 운용하고 있다. 중국은 이를 치명상표(馳名商標)라고 번역하여 사용하고 있다. 중국의 치명상표가 한국의 주지․저명상표와 다른 점은 해당상표의 등록여부를 기준으로 동종 혹은 이종상품에 대한 보호정도가 다르다는 것이다. 치명상표로 인정할 수 있는 권한을 가진 행정기관에는 상표국과 상표평가심사위원회가 있으며, 사법기관에는 중급이상의 인민법원이 있다. 상표국과 상표평가심사위원회는 이의제기나 행정심판 청구과정에서, 인민법원은 상표권 관련 행정소송 또는 민사소송 과정에서 치명상표를 인정한다. 상표권 침해를 입은 당사자는 자신의 상황에 맞는 기관을 선택하여 분쟁을 해결하는 과정에서 치명상표로 인정받을 수 있다. 판례를 보면 중국의 인정기준은 거의 국제적 수준에 도달한 것으로 평가할 수 있다. 그러나 중국 내에서 치명상표를 너무 쉽게 많이 인정하여 본래의 보호취지를 달성하지 못하고 있다는 우려가 있는 만큼, 향후 어떻게 이를 합리적으로 규제할 것인가가 중국정부의 과제라고 볼 수 있다.
Abstract
Well-known marks(WKMs) are trademarks with great popularity and reputation in a certain area. They are more valuable than trademarks and thus more vulnerable to infringement. Therefore, many countries provide broader and stronger protections by laws. Recently China faces on an increasing number of trademark violations by domestic companies infringing on the WKMs of foreign companies. Chinese government is also trying to build an ever-evolving regime for protecting WKMs. With this background, this paper explores methods and guidelines for the determination of MKM status in China. In conclusion, the author finds that China's broad protection system for WKMs is very close to the international standards. To make this effort more effect, China must be coupled with a social consensus on the importance of protecting WKMs.
