초록
국가별로 상이한 표준제도는 무역에 관한 기술 장벽의 핵심적인 요소이다. 각 국가들이 산업별· 업종별 표준, 기술규정, 인증?검사 제도 등을 독자적으로 채택?시행함에 따른 규정 및 절차상의 상이는 국제무역의 비용 상승과 교역 제약 요인으로 작용한다. WTO TBT 협정은 각국 규제당국이 정당한 정책 목표(legitimate objectives)를 취할 권리를 인정하고 국내적 상황에 따라 국제표준으로부터의 일정 수준의 이탈을 허용하면서도 이러한 각국의 표준, 기술규정, 적합성 평가(판단)제도를 국제표준을 중심으로 조화(harmonize)시켜 나가는 것을 근본 목표로 하고 있다. 2001년 출범한 DDA 협상은 비농산물시장접근(NAMA)의 협상의 일부로서 비관세장벽(NTB) 협상을 진행하고 있으며 현재 각국이 제출한 구체적인 NTB 제안서에 따라 상세한 기술적인 토론이 이루어지고 있다. EU 대표단은 “one-product, one-standard, one-test”를 캐치프레이즈로 내걸고 자국의 수출이익이 큰 전기전자, 자동차, 화학 분야에 있어 관련 표준, 기술규정, 적합성 평가의 조화를 적극적으로 추진하는 내용의 제안서를 내어 놓았으며, 그 제안서의 핵심은 자동차, 전기전자, 화학 산업 분야에 있어 관련 국제표준 및 국제표준 기구(relevant international standard-setting body)의 지정이다. 국제표준과의 조화의무를 규정한 현행 TBT 협정 2.4조는 각국의 규제당국의 권한과 국제표준과의 조화간의 미묘한 균형을 이룬 상태라고 볼 수 있다. 그러한 측면에서 국제표준기구를 지정하는 노력이 결실을 맺을 경우 TBT 협정 2.4조상의 국제표준과의 조화의무를 구체화하고 강화하는 결과를 가져올 수 있음은 분명해 보인다. 현재 진행중인 협상을 다루는 관계로 동 논문의 결론은 지극히 잠정적이다. TBT 협정의 개정, 해석의 변경 가능성 등 현재 진행중인 NTB 협상이 TBT 협정에 미칠 영향에 대해서는 지속적인 검토가 필요할 것으로 보이며, 우리의 입장은 우리의 수출이익과 우리의 규제적 권리를 함께 고려하여 정해야 할 것이다.
Abstract
Divergencies of national standards systems have been the very core of technical barriers to trade. Adjustment costs and duplicative efforts due to these divergencies of standards, technical regulations and conformity assessment procedures have caused severely increased transaction costs and even bottlenecks in international trade. WTO TBT Agreement has set the harmonization of national technical regulations with international standards as one of its primary goals, while assuring a WTO member a certain right of deviation from international standards for legitimate policy objectives. Reviewing the track record of WTO dispute settlement cases, the end results is seemingly a delicate balance between harmonization goals and legitimate objectives so far. In ongoing DDA NTB negotiations, while not well known, even forgotten, to the public, very lively technical discussions are underway regarding NTB proposals by EU. These proposals' announced level of ambition is very high: “one-product, one-standard, one-test.” The seemingly modest idea by European Union of designating relevant international standard-setting bodies for some industry standards is attracting heated debate from both developing and developed WTO members because, if agreed, it can significantly strengthen the Article 2.4 of TBT Agreement, with a possible effect of forcing domestic technical regulations truly to be based on international standards without much exception.
