A Study on the system on honorable treatment and support of Public Official Wounded on Duty

“Act on the honorable treatment and support of persons, etc. of distingushied services to the state(In this thesis, calling “The Act”)” defines Public Official Wounded on Duty(calling "Official Wounded") as A person who was wounded and disabled in the line of duty as a public official. It is one in the thousand that Official Wounded would be taken as honorable treatment and support of persons and would be treated and supported by law concerning state merit persons. This study is focused on constitutionality of the system of Official Wounded's treatment and support. First of all, analyzing the history, structure and aim of The Act, In addition, researching the constitutional implication of state merit persons. this study draw a conclusion that state merit persons must have at least 2 element. one is that persons of distinguished services for the State have been sacrificed or have made contributions to the country. the Second is that persons's distinguished services for the State is contributed to improve the cultivation of the people's patriotism, loyalty and national welfare. This study demonstrates that Official Wounded is short of state merit persons's 2 elements and proposed that The Act should rule Official Wounded out.
