인터넷포털의 디지털콘텐츠 공정거래 및 산업활성화 법제방안

Internet service area has grown up dramatically since last a couple of decades in worldwide. In Korea, thanks to well built high speed broadband network infrastructure, Internet service area such as Internet portal, also has grown up fast. However, since Internet service area is so vivid, it is always a little bit difficult to catch up the speed of its development in terms of legal work. It means, the legal foundation is not always changing fast enough to cover current issues in Internet service area, since the speed of Internet service area is so fast. Therefore, to keep sustain development of Internet service area in a good condition and sound way, it needs better systematic legal frame work which considers unique natures of Internet itself. In Korea, not only present the Internet portals information from diverse sources by a tool of the search engine, but also they offer other services such as e-mail, news, stock prices, electronic transaction, entertainment, e-learning etc. The Internet portal has become a central place for digital contents transactions. As a few portals such as Never, Daum, Yahoo and Paran have grown and obtained social-cultural and economic power, unfair trade practices against contents users and contents providers have been increased, which lead a result of shrinking Korea's digital contents market. Therefore, this article deals with the problem which how Korean legal system for digital contents fair trade and industry promotion are changed. For this, it is examining the social responsibility of Internet portal, considering a changed process of legal system for Internet portal and presenting the development direction of legal system for digital contents fair trade and industry promotion which comply with age of cultural state in future. Accordingly, it is expected that the result of this article will give more influence to develop better legal system in Internet portal control, digital contents fair trade and industry promotion in Korea for its sustainable development and prosperity.
