한국 평생교육법제 변화 과정과 주요 쟁점

초록
평생교육법이 2007년에 전부개정되어 2008년에 시행되었다. 그런데 새로운 평생교육법은 시작하자마자 여러 학자들의 비판을 받고 있다. 본 연구는 한국의 평생교육법제의 변화 과정과 그 속에서 나타난 주요 쟁점을 정리할 것을 목적으로 수행되었다. 한국의 평생교육법제는 1980년 헌법에 국가의 평생교육 진흥 조항이 삽입된 이후 1982년의 사회교육법 제정, 1999년의 사회교육법 폐지 및 평생교육법 제정, 2007년의 평생교육법 전부개정의 과정을 거쳤다. 그 속에서 평생교육법을 둘러싼 쟁점 즉, 평생교육 철학에 관한 사회적 합의는 계속 간과되었고 법제는 정책수단으로서 시스템적인 접근에 초점을 맞추어 변화되어 왔다. 그 결과 평생교육법제가 변화할 때마다 매번 유사한 비판이 있어지고 있다. 이러한 해묵은 논쟁을 해소하기 위해서는 평생교육법제의 철학을 분명히 하고 이를 외부와 소통하여 사회적 합의를 이끌어낼 일이 선행될 필요가 있다. 정책수단으로서 평생교육법에 관한 고민은 철학 문제가 해소될 때 비로소 정합성을 가질 수 있다.
Abstract
The National Assembly of (the republic of) Korea wholly amended lifelong education law in 2007. The new law has been put into effect since 2008 and criticized from several scholars. This study purposes to file the changes of lifelong education legislation in Korea and the related issues. Korean people have legislated lifelong education four times; Constitution which is wholly amended in 1980 includes the responsibility of government for promoting lifelong education. According to the constitution, social education law was enacted in 1982. Social education law was amended as lifelong education law in 1999, and it was wholly amended with same name in 2007. A social consensus on philosophy of lifelong education as the critical issues on lifelong education legislation has been overlooked, the legislation has changed with focusing on a system approach as a policy leverage. The results is that there are similar critics on each legislation. The resolution is to clarify philosophy of lifelong education in Korea and to achieve social consensus on the philosophy. System approach is after philosophy.
