전문심리위원을 활용한 의료사건재판

At present, oral examination and simplification of judgment as a basis of it are emphasized in a civil procedure, however, general conception is that it is not easy to effectuate them in a specialized case like a medical malpractice case. But, I have realize through experience that formation of belief by argument in an open court room is fully possible even in a medical malpractice case using a specialized examination commissioner, and that substantial simplification of judgment is possible through the oral argument. I, therefore, wrote this paper to share my experience, and I introduced my trial method as detailed as possible for readers to understand it easily. Formation of belief by oral argument in an open court room and prevention of an unexpected blow through it, and simplification of judgment to build a basis for them are today's inevitable general trends, and a medical malpractice case can not be an exception. As the specialized examination commissioner system helps judges form a belief in a court room by direct assistance of specialists, the system makes oral examination be practicable in a highly specialized field like medical malpractice cases.
