소년법상 화해권고제도의 실질적 운영방안

기존의 소년보호재판에서는 가해자와 피해자 사이에 화해가 필요한 경우 주로 조사관조사를 통해 피해자의 합의의사를 확인하고 통상의 심리기일에 화해를 권유해 오고 있었으나 이러한 방식의 화해권고제도의 운영은 판사가 화해를 주도하게 되어 회복적 사법에서의 자율성이 반감되며 물질적 배상에 중점이 주어질 수밖에 없어 당사자 사이의 진정한 갈등의 해소라는 회복적 사법 이념에 부합하지 않았다. 나아가 업무 부담 등의 사유로 소년법상 화해권고제도가 형식적으로 운영되어 왔는데, 2009년 5월경 개설된 대법원산하 소년보호재판개선연구반에서 민사상의 조정제도와 유사하게 소년법상 화해권고위원을 선정하여 그들로 하여금 실질적으로 화해권고제도를 운영하게 할 목적으로 화해권고제도의 개선을 추진하게 되었다. 따라서 본 발표문에서는 서울가정법원에서 시행하고 있는 소년법상의 화해권고위원제도의 의의와 운영에 관하여 살펴볼 것이며, 운영과 관련하여서는 화해권고 대상 사건과 화해권고위원의 선정을 구체적으로 살펴볼 것이다. 개선된 화해권고제도는 올바른 정착을 위해 관계자들의 많은 노력이 필요할 것이며 바람직한 모습으로 정착될 수 있도록 노력하여 화해권고절차 자체가 가해소년과 피해자에 대한 회복적 사법절차로서 기능할 수 있도록 하여야 할 것이다.
Abstract
When reconciliation is needed between an offender and a victim, an investigator firstly confirms the victim’s intent to agreement and then asks the agreement to both parties on trial date under the existing juvenile protection trial. However, this kind of method does not match with the ideal of the Restorative Justice which is to truly settle the conflicts between the parties. Furthermore, Compromise Recommendation System under the Juvenile Act is operated formally because of judge’s heavy workload. To solve the problem, in May 2009, Juvenile Protection Trial Improvement Study Group is established. It has the purpose to improve the system by choosing the members who are in charge of Compromise Recommendation to handle the system more practically. Thus, this study focuses on the significance and operations of Seoul Family Court’s Compromise Recommendation Member System. Particularly, it is meaningful to search what event can be the subject and how to choose the members. The parties have to take more effort to this new system so that it is able to put down roots in Korea successfully. Hope that the system is working normally as a Restorative Justice Procedure to both parties.
