감사원 자료제출요구권과 개인정보보호 : 합헌적 조화방안을 중심으로

최근 정보사회에서 개인정보보호에 관한 권리의식의 성장은 공행정영역의 제도설계에 있어서 “개인정보의 보호”라는 가치와 그에 필요한 일반원칙의 검토와 고려를 필수불가결하게 하게하고 있다. 이는 감사원의 자료제출요구권의 행사에 있어서도 예외가 아니었다. 회계검사와 직무감찰의 결합된 우리 감사시스템은 세계에서 보기드문 제도임은 주지의 사실이다. 우리나라 독자적인 감사원제도가 출발한지 벌써 60여년이 지난 시점에서 개인정보보호에 관한 권리의식의 성장으로 말미암아 금번기회에 감사원의 자료제출요구제도에 관한 검토를 시작하게 된 것은 매우 유의미한 일이라 생각된다. 독자적인 한국 감사원으로서 재정민주주의 실현을 위한 감사원의 역할, 행정부의 내부통제자로서의 감사원의 역할을 더욱더 원활히 수행하기 위해서라도 감사원법상 분산된 자료제출요구의 관련 조항은 여타 주제의 부속 내용으로서가 아니라 ‘감사자료의 요구, 제출 및 관리’에 포커스를 맞춰 체계적으로 재구성되어야 할 것이다. 더 나아가 감사원의 자료제출요구에 관한 유관 조항을 포함하는 각 영역의 개별법률에 있어서도 감사원의 자료제출근거를 확보할 수 있는 조항을 포함시킴으로 법치감사의 기반을 다져야 할 것이다. 끝으로 감사원 감사권능의 합헌적․합법적 행사를 위하여 감사자료의 제출 및 관리에 관한 법률의 제정을 제안하고자 한다.
Abstract
Information Society being ripen into maturity, People think that it should be more important to protect those personal information(in other words, “Privacy”). So to speak, In most of area(including not only private sector but also public sector) there would be conflict with the native value(or purpose) of each sector and the Right of people's Privacy. Those trends should also occur in the national audit sector. This study considers Both the nature of Korean Audit System and Personal Information Protection System. On the foundation of those considering, suggesting the alternatives. The one is Revision of Both “Board of Audit and Inspection Act” and the other related Act(Basic Act for National Taxes, Personal Information Protection Act in Public Sector etc.) for systemizing the BAI's Request power for Audit materials. The other is enactment of “Basic Act for Submission and Management of Audit Materials”
