초록
근대 이후, 법학 및 사회 전반에 걸친 구성의 전제는 민주주의였다. 현대 사회 구성원으로서의 시민은 보다 나은 삶을 영위하기 위한 목표이자 전제로 민주주의를 이해한다. 또한 정당한 사회의 필수적 요소를 민주주의로 삼고, 민주주의의 실현을 현대 사회의 목표점으로 설정한다. 그러나 민주주의는 하나의 이념이자 제도적 개념으로써 학습되어 왔을 뿐, 실제 생활은 살아가는 자들에게 어떤 당위로써의 감각으로 실현되지 못하는 상황이다. 본 논문에서는 사회 구조적으로 편성된 시선으로의 판단이 아닌, 민주주의가 시대에 따라 작동하는 제도적 이데올로기로써(법치에 이에 속한다는 입장에서 작성), 시민의 일상에서 어떤 방식으로 실현되고 묻어나는지에 대한 고찰의 필요성을 제기한다. 일상을 영위하고 자기 존재 자체를 긍정할 수 있는 삶에서 민주주의의 의미는 무엇인지, 일상과 동떨어진 이념에 그치고 마는 것이 민주주의가 의미할 수 있는 전부인지, 삶의 감각을 되살리는 데 민주주의란 개념이 기여할 수 있는 바는 없는지 제고해 보려 한다. 치열한 자본 중심적 사회에서 생명으로 눈 뜰 수 있는 감각을 되살리는 방법 중의 하나로 일상에 편재한, 서로를 알아채는, 자신을 느끼는 실체 없는 상상물로써의 민주주의를 실재하는 무언가로 의미변경을 가한다.
Abstract
Until the modern society(included legal system) has been constructed to the democracy. The citizen for member of community(or society) which are an eminent own life better than more and more in consequence of democratic frame a system, and they had to understand it. The democracy is essential condition for justified society that realized their's ideal is first things. Nevertheless, considering recent tendency in Korea citizen's sense or thought in which the democracy is just an Idea that doesn't give practical effect to who's real life and practice. In this article, democracy doesn't the sociological studying of systematic discuss about it, that is some kind of ideologies and what is for its operation in human life. What is the meaning of democracy which is someone's personality and being, is the democracy's purpose just ideal? It might be contributed to someone's life. We would be recognized the sense of being a live that slided into each individual things, democratic relationship's possibility has been(it will be) all around ours, the imaginary things could be change to reality in the capitalism world of intensity because democratic sensibility of life is operated and confronted with each other.
