초록
우리가 어떤 수단을 사용하여 국제테러활동범죄를 예방한다 하더라도 이런 범죄를 단기간 내에 철저하게 극복하는 것은 지혜롭지도 않고 현실적이지도 않음을 기억해야 한다. 현대범죄학에 의하면 범죄활동은 인류사회 특유의사회이탈행위이고 국제, 국내 사회갈등이 서로 작용한 각종의 결과임을 보여준다. 그러므로 인류사회가 존재하는 한, 각종 사회갈등은 반드시 발생되며,갈등충돌의 극단적인 형식이 곧 범죄행위로 간주되는 것이다. 테러활동범죄가 일반범죄와 다른 특징을 갖고 있다 하더라도 기왕에 일종의 범죄행위라면그 자체의 생성과 발전은 반드시 일반범죄의 규율을 따라야 하며, 국제협력을통해 완전히 두절된다고 기대할 수는 없는 것이다. 가능한 모든 노력을 기울여 국제사회에서 용인할 수 있는 한도 내에서 억제하고 통제해야 한다. 테러활동범죄 예방의 길에서 직면하고 있는 형세는 매우 심각하며, 갈 길은 아직멀다고 할 수 있다. 어쩌면 독일 형법학자 Liszt의 한 마디 명언처럼 “가장 좋은 사회정책은 바로 가장 좋은 형사정책”이란 것을 국제사회의 테러활동범죄에 대한 효과적인 예방의 대책으로 삼아야 할 것이다.
