The Counteract and Legal System against Child Abuse in Japan

In Korea, many children is suffering by child abuse. In recent, child abuse has increased with the result of the worsening financial difficulties that have occurred in Korea. Child abuse is a important problem because it impedes the physical and mental development of children and is likely to be connected with a violent crime. And child abuse influences not only battered children but also on the society and nation. Therefore, all members of our society - parents, school teachers, private organizations, public institutions, local government and state etc. - shall actively intervene in this problem is required. But general recognition of child abuse is in poor condition in our society. Moreover, most of child abuse has not been exposed. So, legal provisions and social systems to prevent child abuse and to protect or care victims(battered children) of child abuse have not been sufficiently established. The current Child Welfare Act is being widely criticized for its ambiguity, insufficiency and abstractness relating to child abuse. So, we demand to provide an exclusive law, so-called ‘Child Abuse Prevention’, Act for more efficiently preventing child abuse and protecting battered children, separated from Child Welfare Act. And contents about the system of supporting and supervising the executions of the roles of parents taking care of their children have to be included in the law. In this paper, I will examine about ways to reform or newly provide laws on child abuse through studying on development process of counteract system and legal system against child abuse in Japan.
