An Analysis on the Legislative Process for Institutionng the Ministry of Education and Science and Technology: The Politics of Law and Historical Institutionalism Perspectives

본 연구는 교육부와 과기부의 통합 과정에 영향을 미친 정치사회적 맥락을 탐색하고, 정부조직법 개정 과정에서 나타난 정치권과 이해관계집단의 갈등 및 타협 과정에 대하여 분석하며, 교과부 출범 이후 후속조치 과정에서 이러한 상황이 어떻게 전개되었는지를 살펴보는데 목적이 있다. 연구결과에 따르면, 첫째 교육부와 과기부가 통합 과정에는 정책적, 정치적 그리고 법적 현상이 긴밀히 상호 작용하였다. 둘째, 전 과정에서 걸쳐 정치적 고려와 판단이 주요한 역할을 담당하였다. 셋째 역사적 제도주의 관점에서 볼 때, 양 부처의 통합 과정에서 나타난 긴장과 갈등은 오랜 기간 제도화 과정을 거친 서로 다른 역사적 산물을 단기간에 바꾸는 것이 쉽지 않음을 보여준다. 넷째, 비록 국회의 입법과정을 통해 최종 정책결정이 이루어졌지만, 정책의제 설정과정은 정책결정시 고려하게 될 정책대안을 생산하는 과정으로써 의미를 가지며, 따라서 최대한 합리성에 입각할 필요가 있다. 마지막으로 모든 정책 과정에서 같은 유형의 긴장과 갈등이 반복되는 현실을 볼 때, 보다 근본적으로 이를 파악하여 대처하는 방안을 검토할 필요가 있다.
Abstract
This study investigated the sociopolitical context that affected the establishment of the Ministry of Education and Science and Technology by merging two different ministries - the Ministry of Education and Human Resources Development with the Ministry of Science and Technology. The study found: a) combining two ministries entailed interactive process among policy making, politics and legislation; b) political consideration may not be overemphasized in the legislative process for building the new ministry; c) difference in institutional characteristics of two ministries created tension and conflicts when they were merged; d) the agenda-setting process was important in that it in fact limited the scope of decision-making. To throughly combine two ministries, it is necessary to resolve the cultural, psychological, and institutional conflicts between two parties.
