초기 사회과 교과서에 나타난 법교육의 양상에 관한 연구 －교수요목기 공민1 교과서를 중심으로－
A Study on the Aspects of LRE in Early Social Studies Text Books -Focused on syllabus period 'Civics 1' text books

본 연구는 우리나라에서 사회과가 태동하던 교수요목기에 사용되었던 ‘법제(法制)’ 교과서의 기원과 내용상의 특성을 밝히기 위한 것이다. 당시의 교수요목 상 고등학교 1학년에 해당하는 ‘정치생활’ 교과서들이 왜 ‘법제’라는 명칭을 지니고 있었으며 내용의 대부분이 헌법 조항에 대한 직접적인 설명으로 구성되어 있었는지를 확인하는 과정에서 우리나라 법교육의 초기 양상을 파악할 수 있었다. 연구 결과 개화기에서부터 강조되어오던 ‘법률’과목이 일제시대를 거치면서 통치제도 자체에 대한 이해로 축소되어 ‘법제’라는 명칭으로 바뀌었고 이것이 다시 ‘공민’으로 대체되었다가 해방 후 ‘사회생활과’에 포함된 것으로 확인되었다. 해방 직후의 혼란 속에서 일제 시대의 교과서나 용어관행들이 그대로 이어지게 되었고 여기에 1948년 7월 17일 제헌 헌법 제정 직후에 만들어진 교육과정에서 헌법을 국민들에게 알리는 내용에 치중하다보니 통치구조론을 의미하는 ‘법제’라는 명칭과 헌법 조항들을 중심으로 한 내용 구성이 이루어진 것으로 보인다. 전쟁을 겪으면서 국가 정체성의 확립이라는 필요에 의해 헌법의 통치구조론 중심, 법률조항 중심 내용구성은 더욱 강화되었다. 이 과정에서 사회생활과의 애초 목표였던 실생활 중심의 법적 이해와 법의식 함양, 통합적 접근은 사라지게 되었다. 여기에 역사적 상황들이 맞물리면서 법교육이 정치제도에 대한 이해로 좁게 이해되어 독자적인 교육영역을 구축할 수 없었고, 결국 전후 1차 교육과정에서부터 법교육은 ‘정치와 사회’ 중 일부로 축소되어 다루어지게 되었다.
Abstract
This study is about the origin and characteristics of 'Legal System' text book which is used on the early Social Studies period(1946-1954). Why these textbooks were titled 'Legal System' which named 'Political Life' in official curriculum? Why they filled with the constitutional contents? In the pursuit of these questions we can identify the early aspects of LRE in korea. 'Law' had been empahsised from the start of modern education in korea. In colonial era it was reduced to 'Legal System'. Later it changed to 'Civics' and after Liberation legal contents were included in 'Social Studies'. But in the chaos of Liberation the textbooks and titles of colonial era still left behind and 'Legal System' was one of them. And with the first Constitution of 1948, 'Legal System' textbooks used as a pamphlet of newly made constitution to koreans. In Korean War era, constitutional law centered tendency was reinforced to emphasise the national identity. With this the original objects of LRE as understanding the legal life and citizenship were disappeared. In historical circumstaces LRE restrained as a legal system so it couldn't establish the curriculum base of its own. So after the war, LRE reduced to a part of 'Politics and Society' from the 1st national curriculum.
