韓日民事訴訟條約 締結方案의 檢討

The amended Lugano Convention makes it relatively easier for non-European states to accede to this convention which was originally designed with only European countries in mind. On the other hand,Korean and Japanese scholars have discussed about introducing a possible Korea-Japan bilateral convention on international civil procedure. In this background, this paper will examine expected benefits of Korea-Japan bilateral convention in this field and what matters can be dealt with in such bilateral convention. First part makes a general discussion on what benefits can be gained from such bilateral international civil procedure convention, and what form of international agreement is more desirable. Second part makes an overview of concrete matters and issues that could be possible subjects of such bilateral convention.
