南北統一에 대비한 憲法改正의 必要性과 方向

초록
현재 한국은 헌법개정을 준비하고 있다. 헌법개정에 있어서는 남북통일에 대비한 것도 포함되어야 한다. 현행헌법에 따라 남북통일이 갑자기 이루어지는 경우 혼란이 예상되기 때문이다. 현행헌법은 남북통일이 다음과 같은 한계 내에서 이루어질 것을 요구하고 있다. 첫째, 통일방식에 있어서 평화적 통일방식이어야 한다. 둘째, 자유민주적 기본질서를 토대로 한 통일이어야 한다. 셋째, 자본주의에 바탕을 둔 시장경제질서를 토대로 해야 한다. 남북통일에 대비하여 헌법개정을 하는 경우 다음과 같은 점을 고려해야 한다. 첫째, 남북통일을 용이하게 하기 위하여 연방국가제도를 채택하는 것이 필요하다. 둘째, 북한지역이 대한민국에 가입하는 조항을 마련해야 한다. 셋째, 남북통일이 선언되는 경우 남북간의 법규범상의 편차가 잠정적으로 인정될 수 있는 근거규정을 두어야 한다. 넷째, 남북통일이 이루어지는 경우 북한지역의 모든 재산권은 북한주민에게 공평하게 분배될 것임을 규정해야 한다. 다섯째, 정부형태를 의원내각제로 변경하는 것이 요구된다. 여섯째, 국회를 양원제로 바꾸어야 한다.
Abstract
At present Korea is preparing to amend our Constitution. Amendment to the Constitution should include the preparation of unification, since the serious turmoil can be anticipated in case the unification occurs suddenly under the current Constitution. Our current Constitution demands that unification should be done under the following conditions: first, it should be sought a peaceful unification. Second, it should be based on the principles of freedom and democracy. Third, it should be done a market economic policy based on capitalism. This writer strongly suggest that we should consider the following points if Korea wants to amend our Constitution preparing the unification: first, it is necessary to adopt the federal state system. Second, we should provide articles in our constitution that the regions in North Korea enter into the federal state of Korea. Third, we need to install articles to acknowledge the difference of two legal system of North and South temporarily. Fourth, we need to proclaim the all kinds of property in North should be evenly given to the residents of North. Fifth, our government system should be changed into the cabinet government. Sixth, our parliamentary system should be changed into the bicameral system.
