법 인지과학: 법 영역의 인지과학적 조명

초록
인지과학은 인지심리학, 인공지능학, 언어학, 철학, 인류학 등이 서로 밀접하게 연결되어 형성한 다학문적⋅학제적 과학으로, 인간의 지(知)의 문제⋅마음의 문제를 다학문적 입장에서 분석⋅설명하려는 노력의 결집이다. 또한 이는 인문사회과학 대 자연과학이라는 이분법적 학문분류체계가 오늘날 부적합한 분류임을 보여주고 있으며, 마음 또는 인지라는 현상이 다양한 분야의 연구자들이 공동으로 연구해야 할 과제임을 드러내고 있다. 이러한 인지과학에 존재하는 인간의 마음의 작동원리에 대한 기본적 개념들과 원리들은, 최근, 법학과의 학문적 융합을 통해 법인지과학이라는 연구영역을 형성해 나가고 있다. 본 논문에서는 먼저, 법인지과학의 기본 개념과 역사적 연혁, 이론들에 관하여, 간단한 개요를 설명한다. 다음으로, 형법상 행위와 고의, 책임에 관하여, 이 분야에서 법학자들에 의해 진행되어진 최근의 연구에 대해 설명과 법인지과학적 주제들에 대한 미국과 독일에서의 다양한 연구들을 소개하고, 융합적 방법론을 통한 법학에서의 새로운 유망 연구영역의 형성을 제안하고자 한다.
Abstract
In the first decade of the 21C, Law and Cognitive Science are converging to forge a new field of "Cognitive Science of Law”, where the implications of the principles of cognition(mind) found by theoretical and empirical studies in Cognitive Science are becoming reinterpreted, reevaluated, and utilized for various areas of Law, in search for entailing new concepts, theories, empirical evidences, and practical implications. The present paper presents, firstly, a short overview of the basic tenets of Cognitive Science, and of this newly emerging field with its main features and implications. Emphases were given on the two recent approach in Cognitive Science: embodied cognition and narrative approach. Secondly, the paper discusses the recent research done by legal scholars in this field, with an emphasis given on criminal intention and acts; lists of references for various research topics wee also detailed. The paper concludes with a plea for establishing the field as a new promising research area of convergence across disciplines in Korea.
