미국 스포츠 리그 선수회의 법적 지위와 역할

초록
미국 스포츠 리그의 선수회는 선수들의 권익 보호를 위하여 1950년대 중반에서 1960년 중반에 걸쳐 창설되었으며, 1960년대 후반에 전국노동관계위원회에의하여 노동조합으로 인정을 받게 되었으며, 이후 전국노동관계법의 보호하에배타적 교섭권을 가지고 사용자 단체인 리그와 단체협약을 체결해 오고 있다. 이러한 단체협약에는 선수의 고용에 관련된 모든 항목, 특히 선수의 최저 보수 및 보수의 제한(기본보수와 보너스), 계약기간의 제한, 선수계약의 해지, 계약 위반 및 규정 위반에 대한 제재와 그 절차, 선수의 이적과 임대 등이 포함되어 있다. 또한 선수회는 보류제도, 자유계약선수의 이적에 따른 보상제도, 신인선수 지명권 제도(드래프트 제도) 등 이미 연방법원에 의하여 독점금지법에위반된다고 판단되었던 경쟁제한제도들도 리그와의 교섭을 통하여 단체협약에포함시키고 있다. 이는 선수회도 그러한 제도들의 적절한 시행은 스포츠 리그전체의 이익을 위하여 필요하다고 판단하였기 때문이라고 볼 수 있다. 미국 스포츠 리그 선수회는 나아가 선수와 구단 및 리그의 분쟁에 있어서 선수를 지원하고, 선수 에이전트 관리를 위하여 등록제도를 시행하고 있으며, 그룹 라이센싱 프로그램을 운영하여 선수 초상의 집단적 이용을 관리하고 있다. 이와 같이 미국 스포츠 리그 선수회는 노동조합으로서 스포츠 리그 소속 선수들의 이익을 위하여 다양한 역할을 하고 있을 뿐만 아니라 스포츠 리그의 운영의 한 동반자로서 리그 전체의 이익을 위하여 구단 및 리그와 협력해 나아가는 역할을 하고 있으며, 이는 향후 우리나라 스포츠 리그가 발전함에 따라서우리나라 스포츠 리그의 선수회가 담당하여야 할 역할이 무엇인지 그리고 그러한 역할을 수행하기 위하여 갖추어야할 법적 지위가 무엇인지를 잘 보여준다고하겠다.
Abstract
Players associations in U.S. sports leagues were established in 1950-60to ensure that the rights of players were protected both on and off the court, and approved as union for players in league by the National Labor Relations Board(NLRB). Before the unions’ inception, sports players in league did not receive the wide-rangeing privileges and protections that exist today, because U.S sports leagues have adopted the severe labor market restraints, such as the reserve clause and the draft system, and players had no power to negotiate these restraints with clubs and league. Today, under the National Labor Relation Act(NLRA) Players association in U.S. sports league represents all players as an union in matters concerning wages, hours and working conditions and protects their rights as professional sports players by negotiating the Collective Bargaining Agreement, assures that the terms of the Collective Bargaining Agreement(CBA) are met, and surports players in the injury grievance and the non-injury grievance. And in order to increase players’ interest, players association negotiates and monitors retirement and insurance benefits, operates player agent certification system, and provides leadership and management in marketing and licensing of the players, their name and likeness in all areas, including trade cards,video games and apparel by group licensing program.
