WTO 분쟁해결에서 과학의 역할과 한계 재조명 -US-Hormones Suspension 사건을 중심으로-

초록

새로운 과학 기술의 발달과 이로 인해 새롭게 등장한 상품이 지니게 되는 위해성에 대한 논의가 끊임없이 일어나고 인간의 건강과 환경에 대한 관심이 점차 고조되어가는 가운데 자유 무역이라는 원칙이 무역 외 가치의 보호와 어떻게 조화를 이룰 수 있는지에 관한 문제가 계속 제기되고 있다. 특히, WTO의주요 협정 중의 하나인 SPS 협정에서는 위험성이 제기되는 상품의 수출입과관련하여 회원국이 필요에 따라 SPS 조치를 취할 수 있도록 보장하는 한편, 이러한 조치가 비관세 장벽 등 보호주의를 조장하는 방법으로 이용되는 것을 막기 위하여 엄격한 과학적 근거주의에 기초한 위해성 평가(risk assessment)를거치도록 요구하고 있는 바, 이는 WTO가 도모하는 자유 무역 이념과 인간의건강과 안전 보호라는 가치 사이에서 긴장감을 불러일으키고 있다. 그런데 위해성 평가와 관련하여 기존의 과학 기술이나 지식에 의해 판단할수 있는 위험성의 범위가 한정되어 있다는 점이 한계로 지적되고 있을 뿐만 아니라 과학적 증거 외에 각 사회가 처한 정치, 경제, 사회, 문화적인 요소를 고려해야 한다는 목소리가 커지고 있는 바, 이러한 상황에서 WTO 분쟁해결 절차에서 과학적 증거의 역할에 대한 재조명이 필요하게 되었다. 이에, 본고에서는최근 SPS 분쟁 사건인 US-Hormones Suspension 사건을 통해 위해성 평가에있어서의 과학의 역할 변화를 살펴보았다. US-Hormones Suspension 사건의 상소기구가 엄격한 과학적 근거주의에서의과학적 증거와 관련하여 적법한 과학(legitimate science), 또는 옳은 과학(good science)의 중요성을 강조하면서 과학적 증거 형성에 적법 절차(due process)를중시하고 이를 통해 얻어진 결과의 수적인 측면이 아니라 질적인 측면을 강조하고 있는 점은 우리에게 시사하는 바가 크다. 이에 따를 경우 다수 의견에 반하는 소수 의견일지라도 적법 절차(due process)에 의한 정당한 결과라면 얼마든지 받아들여질 수 있는 가능성이 존재하는 것이며, 이는 특히 과학적 불확실성 또는 과학적 증거가 확정적이지 못한 상황에서 회원국들이 합당하고 논리적인(reasonable) 이유와 공정한 절차에 의해 얻어진 과학적 증거를 잠정적 조치의 근거로 활용하고자 할 때 큰 의미가 있다 할 것이다.

Abstract

While the Member State of the WTO has a prerogative right to protect the health and safety of its people, plants and animals as the SPS Agreement grants, such health regulations should not constitute significant non-tariff barriers to trade. The tense relationship between trade and health has been very complicated, and it has indeed reflected the tension between national sovereignty and economic integration and globalization. In practice, The WTO rules and regulations put emphasis on desire to free trade rather than to protect health. Therefore, the WTO, especially the SPS Agreement mandates the Member States to adopt science-driven regulations through appropriate risk assessment in order to identify protectionism and to eliminate such trade barriers. Risk assessment is a heavily scientific process that is supposed to provide the objectively determined and value-neutral scientific evidence. The SPS-related cases in the WTO clearly shows that existence of scientific evidence is necessary to show that the health measure is justified under the SPS Agreement. Therefore, the role of science is significant in the SPS dispute. Despite of its significant role of science in risk analysis, strict requirement of scientific justification is questioned, especially in the face of scientific justification. At this point, the Appellate Body’s in US-Hormones is to be welcomed, as it emphasizes the importance of the scientific method in the production of scientific evidence. In other words, as long as scientific evidence comes from a respected and qualified source, which can be defined, “good science,” the Member States can rely on divergent and minority views of scientific community. Good science is also closely related to the due process in the regulatory proceeding, and therefore, the SPS measure is based on good science, the measure could be legitimate under the SPS jurisprudence. In short, adopting “good science” in scientific justification in the SPS Agreement would contribute to achieving a sensible balance between a Member State’s sovereign right to protect human health and safety in case of scientific uncertainty and prohibition of unjustified trade barriers.
