경기장 및 관중의 안전에 관한 법적 고찰 - 국내 대응 상황과 영국의 입법례를 중심으로 -

초록
다양한 국제스포츠 행사와 국내 프로스포츠 활성화에 따라서 운동경기의 경기장 관전이 이미 대중화되었다. 그러나 경기장내의 관중의 안전과 관련된 사고가 발생하는 상황이 자주 나타나고 있다. 그동안 국내에서는 이러한 상황에 대한 여러 가지 대응책이 논의된 바 있으나, 이러한 사항들을 근본적으로 바로잡기 위한 예방차원의 특별한 법률적인 대책은 없는 실정이다. 해외 프로스포츠 선진국들은 경기장의 사고 예방 및 특정인 관리 법규의 제정을 진행해왔음을 주목할 필요가 있다. 예를 들어, 영국의 관련 법규들은 특정인의 경기장 입장 및 해외출국 등을 제한하는 규제명령 또는 금지명령을 구체적으로 마련하여, 강력한 제재를 부과하거나 예방적 대응이 이루어지고 있다. 영국은 축구장 내의 폭력행위 방지와 훌리건 등 특정인 관리를 위한 일련의 법률제정과 개정을 통하여, 최근까지 경기장 내에서의 관중에 대한 큰 사고를 막고 있다. 해외원정 경기에서도 과거와 같이 영국인 훌리건에 의한 폭력행위 등이 과거만큼 심각하지는 않다. 국내에서도 영국과 같은 경기장의 사고 예방 및 특정 훌리건 관리 법규의 제정 필요성에 시사하는 바 크다. 다만, 영국 관련법상 금지명령과 같이 특정인의 축구경기장 입장 및 해외출국 등을 제한하는 규제명령 또는 금지명령을 국내에 도입하는 경우에는 법적안정성 및 예측가능성, 그리고 국민의 자유보장이라는 측면에서 몇 가지 고려해야 할 사항이 있다. 첫째, 이것은 국민의 자유를 제한하는 것이므로 영국과 같이 ‘법률’의 근거를 가지고 이루어져야 한다. 둘째, 관련 기관의 절차적 투명성을 확보하여 절차적 정당성을 확보해야 할 것이다. 셋째, 규제명령이 행정제재인가 형사제재인가의 법적 성격도 확정하여 관련 사항과의 조화도 유지해야 할 것이다.
Abstract
In Korea, it is popular to watch the sports events at a stadium these days. Although there have been many accidents or violences in sports events, the legal system of Korea is not enough to protect the spectators. After several international sports events such as the Olympic games and the World Cup in recent years, the safety issue of the spectators is becoming one of the main issues considering terrorism and violences at sports events. The study consists of two parts. In the first step, the purpose of the study is to examine several cases regarding the issues of violence and safety of the spectators at sports stadium in Korea. In the second step, the study introduce the legal situation of the United Kingdom. Focusing on the football spectators, the country has developed many national acts such as Football Spectators Act and Football (Disorder) Act to protect the spectators from any violence or accidents in football grounds. Those acts provide various types of rights and duties for the protection for the spectators. Sometimes the activities of the agencies or the government under the acts may restrict the rights of the people. As a conclusion, it is necessary to establish the act in Korea for the safety of the spectators like the UK. Although the act may include some provisions to restrict the rights of people, there must be clear limitations considering the Korean situation.
