지금 우리 민법의 개정을 위한 작업이 진행되고 있다. 민법의 개정에 있어서 무엇보다도 현행 민법전의 체계를 해체하여 우리 민법전의 체계를 새롭게 구성하는 것이 필요하다. 이를 위하여 미군정시대에 한국민법전편찬사업에서 취하였던 민법전의 체계를 참고하는 것을 제언하고 싶다. 미군정시대 미군정청의 법률고문관이었던 로빈기어(Lobingier, C.)의 「한국민법전초안」(Proposed Civil Code for Korea, 1949)이 취하였던 편별방식은 오늘날 새롭게 민법전을 편별하고자 하는데 있어서 매우 적절한 편별방식이 아닐까 생각된다. 민법의 개정은 어려운 것이고 힘이 드는 일이지만, 그 개정작업에 있어서 먼저 민법전의 체계를 어떻게 할 것인가를 해결하는 것이 필요하다. 다음으로 이와 같은 민법전의 체계 속에 무엇을 담을 것인가를 시간을 갖고 논의를 하여 결정하는 것이 올바른 수순이라고 생각되어서 민법전의 체계에 대하여 제언하는 것이다. 이번 민법전의 개정은 우리 손에 의한 진정한 민법전의 제정과 같은 의미를 갖게 되기를 바란다.
Abstract
The Korean Civil Code is under amendment currently. What is required most in amending the Civil Code is dismantling the structure of the current Korean Civil Code and restructuring the system anew. For this, this study suggests referencing to the structure of the Civil Code adapted in the Codification of Korean Civil Code during the period under the U. S. Army Military Government in Korea(1945~1948). The survey method that Lobingier, C., the legal advisor of the U. S. Army Military Government, adopted for the Proposed Civil Code for Korea(1949) is considered a very adequate survey method for reviewing the Korean Civil Code today. The amendment of the Civil Code is a difficult and laborious job, but in the work we need to decide first the structure of the Korean Civil Code. The desirable next step is discussing and deciding what should be contained in the structure of the Civil Code. We expect that the amendment of the Korean Civil Code at this time may be as meaningful as the new establishment of the Civil Code by ourselves.
