제주특별자치도 관광레저상품 육성을 위한 법적 과제

개인의 소득증가와 여가는 삶의 질 향상에 대한 다양한 욕구를 불러일으키고 있다. 그 욕구 중의 하나가 레저활동이다. 레저활동 인구가 증가함에 따라 각 지방자치단체는 레저활동참가자를 유인하기 위하여 관광레저의 육성을 정책적 과제로 삼아 관광레저 상품개발에 박차를 가하고 있다. 관광레저 상품 개발을 하기위해서는 관광레저의 인프라도 중요하지만 무엇보다도 관광환경변화에 따른 시대적 요구에 부응하기 위하여 법·제도적 장치가 마련되어야 한다. 관광레저와 관련하여 통일된 법체계가 마련되어 있지 않을 뿐만 아니라 그 범위가 다양하고 다른 법률관계에 따른 혼잡성에 따라 통일된 법령이 요구되고 있다. 이에 제주특별자치도는 제주특별자치도설치및국제자유도시조성을위한 특별법상의 조례 제정권의 위임 규정에 의해 조례 등 입법안을 추진할 필요가 있다. 따라서 본고에서는 관광레저관련법의 주요현황을 살펴보고 검토함으로써 법적 문제점을 도출하여 관광레저 상품 개발을 위한 체계적이고 효율적인 입법 방안을 제시하고자 하였다.
Abstract
Today, private incomes and leisure arouses various desires of raising the quality of one's life. One of the desires is leisure. As population with leisure activities increases, each local government spurs tourist leisure commodity development making a policy tasks to attract participants in leisure activities. To develop tourist leisure commodities, tourist leisure infra is important, but above all, legal and institutional strategy should be provided to meet the needs of the times with changes in tourism. Not only unified legal system is not provided in related to tourist leisure but also its scope is various and different legal relationship complicates, so unified amendment is needed. On this, Jeju Special Self-Governing Province needs to proceed bills such as act by delegation provision of ordinance legislation on special law for establishing Jeju Special Self-Governing Province and preparing Jeju Free International City. Therefore, by examining important present conditions of law related to tourist leisure to deduce legal problems, this study tries to suggest systematic and effective legislation plan for tourist leisure commodities development.
