건강한 삶을 위해 그리고 경제적 이익을 위해 필연적으로 해야 하는 일이라면 녹색성장을 어떻게 이루어야 하는 것일까? 서로 모순되는 두 단어, “녹색과 성장”을 하나로 만들기 위해 지향해야 하는 방향은 무엇인가?그것은 녹색과 성장의 최적 조합을 찾아내는 일이다. 이를 위해서는 첫째, 무엇보다도 합리적인 계산과 철저하고 신중한 검증이 필요하고 모두가 꿈꾸는 맑은 자연처럼 투명한 정책 결정과 시행 그리고 국민 전반의 의식개혁이 선행되어야 하는 것이다. 둘째, 환경오염내지 환경파괴 등 환경범죄와 관련된 문제의 심각성에 적극 대처하기 위해 행정법적 규제 외에 형법적 차원에서의 제재강화가 필요하다. 따라서 본 논문에서는 녹색성장 그리고 녹색성장기본법의 정확한 의미를 살펴보고, 환경범죄에 관하여 형사법적 관점에서의 제재를 검토하고, 최근 녹색성장과 관련하여 환경형법이 나아가야 할 역할과 과제에 대해 고찰해 보고자 한다. 녹색성장 기본법이라는 첫 단추가 꿰어진 상황에서 이제는 좀 더 세련되고 정밀한모든 것을 포괄하는 법체계를 준비하는 차원에서 이 논문이 이 문제에 대한 단초를 마련하는 계기가 되길 바란다. “연못에 수련(水蓮)이 자라고 있다. 수련이 하루에 갑절로 늘어나는데 29번째 되는날 연못의 반이 수련으로 덮였다. 아직 반이 남았다고 태연할 것인가? 연못이 완전히 수련에게 점령되는 날은 바로 다음날이다.” -로마 클럽 보고서 「성장의 한계」에서
Abstract
If there is something to do to live good healthy lives and for the economic benefit, how do we make green growth? What is the upright direction of the aim to unify the different two concepts, "green and growth", which is contradictory to each other, without conflicts. That is the finding optimum combination of green and growth. In order to achieve this agenda, firstly it is needed to be reasonable calculation and prudent and thorough verification required, and transparent policy decision and their out-and-out executions are also called for. Furthermore, it is said that the sense of citizenship reform in the entire nation scale must precede any probe by them. Secondly, to cope with serious environmental crime related environmental destruction and pollution, the restriction or sanction enforcement in the criminal level in addition to the administrative regulations are definitely necessary. In this work, I explore the exact meaning of the "green growth" and "Framework Act on Low Carbon, Green Growth", the sanction on the environmental crime in the criminal law perspective. With regard to the green growth, I would like to study the role and tasks of the environmental criminal law which should be precede points that we desired.
