서민주거생활의 보장을 위해서는 본 논문에서 언급한 주거생활보장기본법(안)이라는 주거기본법 제정논의가 필요하다. 주거생활보장기본법(안)에서는 주거정책의 기본방향을 제시하며, 국가 및 지방자치단체와 각종 개발사업자가 지켜야 할 기본사항을 정해야한다. 주거생활보장기본법(안)의 기본이념이 적절한 주거의 확보를 바탕으로 한다. 주거정책의 기본이념을 구체화하고, 국가 및 지방자치단체는 특히 저소득층(사회적 취약계층)을 위한 임대주택의 건설·공급에 정책의 우선 순위를 둔다는 점, 주택자금의 지원 등, 주거관련정보, 쾌적한 주거환경의 보호, 공동주택의 관리, 주거환경의 개선, 개발사업의 시행에 따른 주거환경의 보호, 임차인의 보호, 철거민의 보호 등의 내용을 담고 있어야 할 것이다. 본 논문의 제2장(주거생활보장기본법 제정의 필요성)에서는 주거생활보장기본법 제정의 필요성 및 법제정의 타당성 여부를 다룬다. 주거생활보장법(안)의 기본법으로서의 역할 및 헌법적 근거를 분석하였다. 제3장(일본의 주생활기본법 함의)에서는 2006년 시행된 일본의 주생활기본법 제정 배경과 내용을 분석하였다. 이를 바탕으로 우리나라에 주는 시사점을 도출하였다. 제4장((가칭)주거생활보장기본법 시안의 구성체계)에서는 주거복지의 개념 및 주거생활보장기본법(안)의 주요내용으로 ① 정부와 지방정부의 주거복지 실현의 책무부과, ② 최저주거기준의 법제화, ③ 장단기주택정책의 수립, ④ 주거복지위원회의 구성 명시, ⑤ 사회적 취약계층 주거권리보장 등의 내용을 제시하였다.
Abstract
Everyone shares the right to a decent standard of living. Essential to the achievement of this standard and therefore to the fulfillment of human lie beyond simple survival is access to adequate housing. The right to housing codified as a human right in the Universal Declaration of Human Rights. And The right to housing is included in several international legally-binding documents such as UN-Habitat and UN Housing Rights Programme,Increase in the housing supply ratio through mass housing construction has long been the prime object of housing policy in Korea as housing shortage was regarded as the main element of housing problem. The government enacted the Housing Construction Promotion Law (HCPL) in 1972 in order to promote housing construction. The HCPL has since then served as the organic law of housing in Korea. It prescribes on simplified legal procedures and financial assistance to promote housing development, and the inspection of construction works and the standardization of building elements to help heighten construction quality and productivity. And, new topics such as the harmony of development and environmental protection have become important policy issues. Moreover, the situation of those who are unable to afford appropriate housing on the market has been aggravated relative to the aggregate improvement in housing conditions. Many families are still living in houses that do not meet the minimum standards. How to provide appropriate housing for those in housing poverty and how to enhance the housing standards of those living in substandard housing are thus becoming the main concern of housing policy. Korea has the constitution and national laws that promote the progressive realization of the right to adequate housing. In Korea legal protection of the right to housing at the national level often involve arbitrary eviction, safety and health regulations, or equal protection issues. The housing policy should be oriented around securing the right to housing and the affordability of housing, particularly for the underprivileged groups.
