방송프로그램 형성의 법적 기준과 미래지향적 심의정책

지난 2008년 신설된 방송통신심의위원회(이하 ‘심의위원회’)는 방송과 통신 및 융합분야에 대하여 통합적으로 내용심의를 담당하고 있다. 심의위원회는 방송 분야에서는 방송 분야의 전반적․종합적인 정책입안권 및 집행권과 아울러 ① ‘방송’의 내용, ② ‘중계유선방송’ 및 ‘전광판방송’의 내용과 ③ ‘기타 전기통신회선을 통하여 공개를 목적으로 유통되는 정보 중 방송과 유사한 것으로서 대통령령이 정하는 정보’의 내용이 공정성과 공공성을 유지하고 있는지의 여부와 공적 책임을 준수하고 있는지의 여부를 방송 또는 유통된 후 「방송법」 제33조의 심의원칙에 의거하여 심의․의결하고 있다. 이 논문에서는 자극적이고 선정적인 방송내용이 지속적으로 방영이 되고 있는 현실에서 방송심의에 있어 적정한 기준과 방송의 공적 성격을 지키기 위해 방송프로그램들에 대한 심의기준의 설정과 기준의 법제화 가능성을 모색하였다. 현재 가장 문제가 되는 방송의 내용은 성(性)을 도구화ㆍ희화화하거나 막말, 욕설이나 외설 폭력 등 어린이와 청소년의 건전한 가치함양에 저해가 되는 내용들이다. 여기에서는 어린이와 청소년의 건전한 성장을 저해하고 사회의 건전한 생활풍토 조성을 위하여 일정한 방송의 내용들을 엄격하게 심의하되 방송에 있어서의 표현의 자유도 아울러 준수해야 한다는 점을 밝히고 있다. 향후 방송의 품격과 윤리성 제고를 위해서는 자율심의의 확대와 위원회의 심의제도와의 조화, 시대가치를 반영한 심의기준의 정립과 정비, 어린이와 청소년 보호 및 건전한 사회가치 함양을 위한 내용 형성, 심의기준의 객관화․정형화, 탄력적인 광고심의제도 운영 등의 내용이 상세하게 법제화되어야 할 것이다.
Abstract
Impact of Mass Media, especially TV brings together the most current ideas on how the mass media influence our age. Nowadays in korea more and more much concern is being voiced about the violent and sexually suggestive content on television program. The number of complaints filed with the Korea Communications Standards Commission(hereinafter ‘KCSC’) also showed a sharp increase. The KCSC, an independent statutory organization, ensures proper functions of communications, which is helping a nation to create a sound political willingness as well as providing audiences and users with pleasure, education, and beneficial conversation. In general before the deliberation, content ratings allow you to prevent users from viewing sites with risky content. Ratings are set on a per-site basis and are rated by the author for degrees of risky language, nudity, and violence. But after telecast of the TV programs must the contents comply with the broadcasting review regulations. The KCSC has been established to ensure the public value and fairness in the content of the broadcasts, promote the sound culture in the field of communications and create a communications environment of proper usage. For the establishment of future-oriented deliberating system on TV it is necessary to consider the proper deliberation standard and co-working self-regulation with various agencies and broadcasting systems.
