초록
변호사의 업무수행에 있어서 변호사사무직원, 즉 사무장, 사무원의 도움은 필수적이다. 최근 변호사업계의 불황으로 변호사가 직접 사무장의 역할을 겸하는 경우가 존재한다고는 하더라도 아직도 상당수는 상담, 사건처리와 법원접수 및 집행등의 단계에서 변호사사무원들의 도움은 결코 간과할 수 없다. 이러한 과정에서 변호사가 아니지만, 실제로 법적인 업무를 담당하고 있는 이른바, 패러리걸들이 그 업무처리과정에서 변호사와 동일한 내지는 다소 완화된 형태로 직업윤리를 준수해야한다는 점은 이제 결코 그저 간과할 문제가 아니다. 이에 본 논문은 변호사사무직원, 다른 말로 변호사보조직들이 지켜야 할 직업윤리를 광의의 법조윤리관점에서 검토하고 이에 대한 제도적인 통제와 외국의 경우를 참고한 윤리지침의 가이드라인까지 제안해보고자 한다. 변호사윤리는 변호사사무직원의 윤리를 정리함으로써 완결될 수 있는 미완성의 윤리다. 따라서, 변호사사무직원의 교육과 훈련, 그리고 연수등에 관한 윤리장전이 반드시 마련되어야 할 것이고, 이를 달성하기 위한 인증제도나 시험제도도 반드시 도입되어야 할 것이라는 것을 지적하고자 한다.
Abstract
Paralegal‘s assistance is essential to lawyer's legal practice. This can not be changed by the recent currents that lawyer him/herself does legal practice without paralegal's help because of the economic depression. In the course of process, paralegals who have dealt with many legal cases should follow the legal ethics as far as lawyers do, even if the standard of ethics somehow be lowed in some situations. This problem must not be overlooked. In this article, we explore the development of paralegal concept and examine the legal ethics of paralegal in many countries, eg. USA, Canada, Deutschland, China, Japan. And we also try to set minimum standard for regulating the paralegals in the eyes of legal ethics, based on the research about the foreign and domestic legal system. Lawyers' ethics is to be fully established by set the base of the legal ethics of paralegal and until then, it can not be wholly equipped. Lawyers' association must start the program to educate the paralegal-candidate to well-equipped paralegals and establish the guidelines or model code of ethics for enforcement. Accreditation, exam and registration process would be needed for better legal environment. Afterwards, I hope further research relating this issue might be followed with wider range.
