초록
우리나라의 사립학교는 대한민국 수립 이후에 부족한 공교육을 대체하는 것으로 출발하였기 때문에 공교육체계와 본질적으로 유사한 기능을 담당하였다. 이로 인하여 사립학교의 자주성보다는 공공성이 지나치게 강조되는 결과를 초래하였다. 그러나 사립학교의 공공성만이 강조된다면 우리나라의 교육은 그 미래가 없다고 보아야 한다. 그 이유는 교육의 본질 자체가 외부적⋅획일적인 통제와 어울리지 않기 때문이다. 특히 사립학교의 교육은 자주성을 그 생명으로 하여야 한다. 다양하고 수준이 각기 다른 수많은 학생들의 잠재력을 이끌어내고 그를 통하여 우리나라의 발전을 이끌어가기 위해서는 교육의 다양성이 확보되어야 한다. 저자는 사립학교에 대한 규제가 전면적으로 없어져야 한다고 주장하는 것은 아니다. 그러나 사립학교의 공공성이 강조되는 정도로 사립학교의 자주성이 고취될 수 있는 균형적인 사립학교법제를 가져야 한다고 생각한다. 본 연구에서는 사립학교법의 변천과정과 현행 사립학교법의 구조 분석을 통하여 우리 사립학교법이 조성보다는 통제 중심의 사학 감독 체제를 기조로 하고 있다는 점과 사립학교의 자주성보다는 공공성이 지나치게 강조되고 있다는 점을 명확히 하였다. 우리 사회의 민주화 정도나 국민의 의식수준 등을 고려해보면, 이제는 우리 사립학교법제도 사학에 과중한 의무와 책임을 부과하는 통제법적 방향보다는 사학의 특수성에 따른 자주적 운영과 육성에 중심을 두는 방향으로 개정될 필요가 있다.
Abstract
The purpose of this article is to suggest how to amend the Korean Private School Acts. Korean private schools carry historical and ideological features: autonomy and publicity. Any of these features should not be ignored. Both of them are to be equally respected. However, the authors have come up with that the publicity of the private schools had been overly emphasized than the autonomy of the private schools. We have not only studied the historical prospect of 43 amendments of the Private School Acts but also analyzed the structure of the current Acts. Especially, among the 33 sections of the Korean Private School Acts which are related to the competent authority, 30 sections are for the governmental regulation but only 3 sections are for the administrative support for the private school. Futhermore, 37 sections of the Acts are related to the publicity of the private schools, while 15 sections are related to the autonomy of the private schools. Thus, the authors suggest that the Private School Act should be revised to the direction that the autonomy of the private school should be a little more secured.
