Exploitation of Intellectual Property Rights and Financing Structure

Intellectual property has emerged as a key strategic assets for the economic growth of a company and a nation. The recent surveys indicates that for the last three decades intangible assets have replaced tangible assets as the most important factor in driving economic performances and most of the leading companies in the world have intangible and intellectual assets with substantial value. In such circumstances, companies and governments are paying attention to how to exploit intellectual property. In this context, financing is an important element to support commercialization of intellectual property and IP monetization is often used to refer to financial methods relating to IP exploitation. Monetization, in general, means identifying different methods to extract value from assets and IP monetization is the process of extracting value from intellectual property. The process of monetizing intellectual property can take many forms, from outright sale to secured financing, to orderly management and disposal of the assets. Among the monetization methods, IP securitization has become an important financing technique. However, it should be noted that IP securitization is a funding method and not a method to convert IP assets to profit-generating assets. From this perspective, this paper examine IP financing methods in connection with the life cycle of intellectual property and positioning of securitization as a financing technique for IP based companies. In relation to pooling of cashflow-generating IP assets, the role of IP trustee is explored.
