This paper studies whether the payment system by dividing monthly as a severance has the effect under the circumstance of the spread of performance-based annual salary settlement. The result suggests that the effect of severance arrangements related to partial payments for the longevity of future pre-settlement agreement may not be effective, while previous to the longevity of the effect of a legal settlement shall be acceptable. Although the legal requirements were equipped with partial payments of the amounts corresponding to the retirement benefits for the future, the nature of benefits might be unjust enrichment that would be returned to the employer in terms of equity. Also it is necessary to accept that the offset nominal amounts paid severance to retirement benefits, because it, considerably, related to the severance pay claims. In this case, according to the Civil Enforcement, it is desirable to allow only offset over half of severance payment.
