17대 임기 만료에 따른 폐기 법률안의 특징과 정책적 시사점

초록
제17대 국회에서 처리된 법률안은 총 7,489건으로서 기하급수적으로 늘어났으나, 반면 폐기된 법률안도 많다. 특히 제헌국회부터 제17대 국회까지 의원발의 법률안 중에서 임기만료로 인해 폐기되는 법률안의 비율은 평균 26.7%이지만, 제17대 국회에서는 51.4%를 나타냈다. 임기만료폐기 법률안을 제안유형에 따라 분류하면 의원발의가 많으며, 임기 초에 제안된 법률안이 많으며, 행정자치위원회의 법률안이 가장 많았으며, 재정경제위원회, 보건복지위원회, 법제사법위원회 순으로 많았다. 참여의원 수로 분류하면, 11명에서 20명 사이의 의원이 발의 및 참여하는 법률안이 가장 많았으며, 발의 및 참여위원이 많을수록 폐가 건수가 적었다. 임기만료폐기 법률안을 대표발의 의원 소속 정당별로 분류하면, 한나라당 소속 의원이 대표발의 한 법률안이 51.7%로 가장 많았으며, 다음으로 열린우리당 소속 의원이 대표발의 한 법률안이 38.2%이었다. 원인별로 분류하면 특정 집단 관련 법률, 기득권 보호 차원, 재원 부담에 대한 합의 도출 부족, 매우 이상적인 법률, 유권자들의 눈치보기식 법률안, 정부조직 개편안 관련 폐기법률, 협의 과정의 부족, 정치적인 사안의 표류, 과잉의욕 등이 지적되었다. 향후 임기 만료로 인한 폐기 법률의 가능성을 줄이기 위해서는 갈등을 조정하고 합의를 도출하는 적극적인 노력이 필요하며, 이를 위해 국회 공청회 활성화, 국회 입법지원 활동 강화 등의 지원이 필요하다. 그리고 갈등조정 기능의 강화를 위한 정당의 노력과 의원의 역량 강화를 위한 교육도 필요하다.
Abstract
The 17th National Assembly handled a total of 7,489 laws, while there are many obsolete laws. From the Constituent Assembly to the 17th National Assembly, the average rate of disposal law by the expiration is 26.7 percent. But the 17th National Assembly shows 51.4%. Analyzed by proposal identity, some results were found. The proposals by members are higher than the governmental proposal. When the proposal were made at a initial term, the discarded rate were higher. The Administration and Autonomy Committee has the largest portion and next followed the Finance and Economy Committee, the Health and Welfare Committee, the Legislation and Judiciary Committee. The more members were participated, the less proposals wee discarded.. The proposals by ruling part had the largest potion of discard and followed the second party. Classified by the cause, some factors were pointed out; laws related with specific group, protecting vested interest, too ambitious and ideal law, voters maximization behavior, the government reorganization plan law, lack of the consultation process, political issues, over-motivated initiative. To reduce the possibility of waste laws, some institutional arrangements recommended; utilization of congressional hearing and the professional legislative supporting body. Above all, the strengthening of conflict resolution capabilities by the party's efforts and training for capacity building is needed.
