고충처리의 ADR식 해결방법

초록
우리나라에서 30인 이상 사업장이면 고충처리위원을 두어야 함에도 고충처리 활용도가 저조한 실정이다. 또한 고충이 노사협의회에서 해결되지 못하면 임의중재로서 해결하는 길을 열어두고 있으나 그 활용도가 미미하고 고충처리절차가 완결된 구조를 갖지 못하고 있다. 우리나라 고충처리제도는 일본과 유사하게 영미식과 유럽식의 혼합유형으로 유럽식의 노동법원이 없는 상태에서 보다 완결된 외부 해결을 위한 영미식의 ADR방법을 활용할 필요가 있다. 최근 일본에서 노동재판소와 더불어 분쟁조정위원회를 도입한 것도 같은 맥락에서였다. 새로운 고충처리절차로서 노사협의회에서 해결이 되지 못할 경우 외부 중립인의 조정과 중재를 받아 볼 수 있고, 조정 후 법원 판결을 받아 최종 결론을 내릴 수 있는 완결된 외부 해결을 구축하였다. 또한 내부 해결에서도 고충회의에서 고충 제기 근로자의 직접 해결이나 고충처리위원과의 공동 해결을 도입하여 자율적 내부 해결도 강화하였다. 마지막으로 ADR식 고충처리제도가 성공하기 위해서 관련 법률의 개정, 조정․중재 전문가 양성의 교육비 지원, 조정․중재인 명부 등재, 외부 조정․중재서비스에 대한 일정 기간 예산 지원 등 정책적 과제를 제안하고 있다.
Abstract
Although a grievance committee is required to be established at workplace with more than 30 employees, grievance procedures are rarely used in fact. In addition grievances are not finally concluded with unusual arbitration despite they may be resolved by voluntary arbitration. There are Anglo-American and European style of grievance procedure whereas Korean and Japanese grievance procedure is a mixed style. We need to adopt ADR in grievance resolution for a complete grievance system without European Labor Tribunal as in Anglo-American style. This is similar to a recent trend in Japan. A new grievance procedure includes mediation and arbitration by outside neutrals or legal judgement after mediation if a grievance is not resolved in the labor-management committee. It also includes voluntary direct inner resolution in which a grievant participates in grievance meeting alone or together with a union steward. Finally policy tasks are suggested for successful grievance resolution by ADR such as revision of related laws, assisted training of mediators and arbitrators, registration of mediator-arbitrator roster, a subsidy to mediation and arbitration service for the beginning period, etc.
