남북한 저작권법제의 비교에 관한 연구

Although North Korea practices the copyright law, the law itself includes the characteristics of legal systems in socialist countries; creative activities certainly has limitation, and the individual rights and freedom of expression, which is an original function and role of whole copyright system, are apparently restricted in the country. Legally guaranteeing individual works in North Korea is aimed to awaken protection of their copyrighted materials and reinforce a sense of ownership. South Korea and North Korea, separated for more than half a century, each have accumulated vast amount of copyrighted works under the two opposite regimes, and when inter-Korean exchanges are vitalized again in the future, mutual protection of copyrighted works from each country and the access to the North Korean works will be much in need. This thesis, in response to the realistic need, provides the foundation for integrating the legal system on copyright laws of South Korea and North Korea through the comparative analysis. Part II of this thesis illustrates the main contents and the overview of Copyright Act of two Koreas. Part III compares the composition of the legislation. Part IV compares substantive laws, and Part V compares procedural laws. Finally, Part VI concludes the study by proposing the direction for integrating the legal system on copyright laws of South Korea and North Korea.
