정책수단으로서 부동산 조세에 관한 연구

초록
본 연구는 우리나라의 부동산 조세정책이 부동산 투기억제에 중점을 두고 운영되었음을 보이고, 그것이 부동산 가격안정에 미친 영향과 국가의 재원확보가 아닌 국가의 정책수단으로 사용하는 것이 조세의 본질에 비추어 가능한 것인지와 그 한계 및 통제수단 등을 이론적으로 검토하여, 부동산 조세의 현황과 문제점 및 개선방향에 대하여 그 효과를 분석하고 부동산 조세정책의 시사점을 도출하는 것을 목적으로 한다. 한 나라의 조세는 국가의 경제 및 재정정책에 근간을 이루는 것으로써, 조세논리와 경제적 효율성에 바탕을 두고 수립되어야 한다. 또한, 조세를 통하여 추구하는 목적이 정당하다고 하더라도 부동산투기대책으로 사용하는 조세수단은 효율적이어야 하며, 아울러 국민의 자유로운 형성권 및 재산권을 과도하게 침해하지 않아야 한다. 부동산투기의 발생은 기본적으로 경제적인 현상이므로 여기에 대응하는 정책 역시 경제에 기반을 준 것이 적합하다. 부동산투기억제정책으로서의 조세는 주된 정책을 보조하는 수단에 지나지 않고 정부의 조세정책이 부동산투기억제의 주된 정책이 될 수 없다. 부동산 조세정책이 단기적 시장변동에 대한 대응 정책으로 사용되지 않아야 하며, 부동산 조세는 우선적으로 각 조세의 특성과 기본임무를 고려하여 추진함이 바람직하다.
Abstract
The property tax policies have been applied to control purchasing real estate only to make a profit. At first, this study explained the effects of the property tax regulations to stabilize housing price. In general, tax policies are aimed at increasing the nation’s tax revenues, but the government used property tax to stem speculation when the market is overheated or to stimulate demand when the market is contracting. In a short-term, the government’s intervention did work but, it may cause negative side effects in the long-term. The potentials and limitations are reviewed in details. This study suggested the nation’s taxation should be developed based on the socioeconomic condition and the effectiveness of the market. This major finding in this study included three things; (1) the application of the property tax could not infringe property rights in private parts, (2) real estate speculation is need to be understand as a part of economic activity, (3) the application of the property tax aiming regulate real estate speculation is not a primary policy. When property tax is provided, it is recommended to considering characteristics and major purpose of each different taxations.
