해상교통관제는 선박통항의 안전과 효율을 증진시키고 해양환경을 보호하기 위한 목적으로 전 세계 주요항만과 수역에서 운영되고 있다. 우리나라도 1993년 포항항 VTS를 시작으로 전국 주요항만으로 확대 설치하여 현재 15개소에 운영 중에 있으며, 2004년 진도 연안 VTS의 설치를 시작으로 관제범위를 점차 확대하여 시행하고 있다. 그러나 VTS의 설치 및 관제범위의 확대에 비해서 VTS에 관한 법제는 각 개별입법 내에 산재해 있는 실정이다. 특히 VTS의 법적근거, 책임과 권한 등에 대한 명확하고 상세한 규정이 없기 때문에 VTS의 효율적인 운영에 한계가 있다. 따라서 이 논문에서는 먼저 유엔해양법협약과 국제해사협약을 중심으로 VTS에 관한 국제법 규정과 국내법 규정을 살펴본다. 그리고 국내의 VTS와 유사한 교통관련 관제를 실시하고 있는 항공교통관제제도의 체계적인 법제를 비교·분석하여 국내 VTS 관련 법제의 문제점을 검토한 후 우리나라 VTS의 효율적인 운영을 위한 관련 법제의 개선방안을 제시한다.
Abstract
VTS (Vessel Traffic Service) is operated in major harbors and waters all over the world for the purpose of protection of ocean environment as well as improvement of safety and efficiency of vessel sailing. Currently our country also operates VTS in 15 ports from the start of the first VTS in Pohang Port in 1993 and expansion and installation to the major national harbors and from the beginning of installation of Jindo coastal VTS in 2004, the service scope is gradually expanding. But, compared to the service scope and expansion of VTS installation, the legislation about VTS is in the scattering state in each legislation. In particular, because obvious and specific regulations about VTS legal grounds and responsibilities and authorities don't exist, efficient operation of VTS faces restrictions. Accordingly, first of all this study reviews the domestic law regulations as well as the international law regulations about VTS focused on the United Nations Conference on the Law and International Maritime Conventions. Moreover, Through comparison and analysis of the systematic legislation of the Air Traffic Control performing a similar traffic related service to the domestic VTS, the problems of the domestic VTS related legislation will be reviewed and then improvement plans of the related laws for the efficient operation of our VTS will be suggested.
