해기사 양성 국립대학교의 남녀구분모집에 대한 합헌성 분석
A Constitutional Analysis on the Sex-Based Classification in the Admissions Program of the National Maritime University

합리적인 이유 없이 성별을 이유로 교육의 영역에서 특정한 사람을 우대·배제·구별하거나 불리하게 대우하는 행위는 원칙적으로 금지된다. 그런데 해기사 양성을 주된 목적으로 설립·운영되고 있는 국립대학교의 일부 단과대학과 학부(한국해양대학교 해사대학과 목포해양대학교 해상운송시스템학부 및 기관시스템공학부)에서는 신입생 모집과정에서 남성과 여성을 구분하여 모집하고 있다. 그 결과, 경우에 따라서는 남성지원자보다 더 높은 성적을 획득한 여성지원자가 단지 여성이라는 이유 때문에 탈락하는 문제가 발생할 수도 있는데, 이는 헌법상 보장된 기본권을 침해한다는 비판에 직면할 수 있다. 따라서 본 논문에서는 해양대학의 남녀구분모집의 문제점을 헌법적 관점에서 분석·규명하고 양성평등실현을 위한 정책적 대안을 제시하고자 한다. 이를 위해, 우선, 해양대학에서의 남녀구분모집의 현황과 이유 및 현실적 문제점을 검토하고(Ⅱ), 남녀구분모집의 문제점을 헌법적 관점, 특히 평등원칙 위반 및 평등권 침해의 관점에서 분석한 후(Ⅲ, Ⅳ), 이를 토대로 문제점 극복을 위한 정책적 대안을 제시한다(Ⅴ).
Abstract
An act that discriminate against, without a rational reason, a particular person on the ground of sex in the area of a education, is prohibited. However, some college and division of the national maritime university (the College of Maritime Sciences of the Korea Maritime University, the division Maritime Transportation System and Marine Engineering of the Mokpo National Maritime University) has been used the sex-based classification in the admissions program. Therefore, in some cases, the female applicants have obtained a higher score than the male applicants, only because of a sex, may fail to admission. Namely, this may violate the constitutionally guaranteed rights. This paper aims to present alternatives for the realization of substantial equality in the area of a education, through a constitutional analysis on the sex-based classification in the admissions program. For this purpose, we, first, review the present status and problems of the sex-based classification in the admissions program(Ⅱ), second, analyze it in terms of the Constitution, especially the principle of equality or the right of equality(Ⅲ, Ⅳ), finally, present an alternative to overcome it(Ⅴ).
