항만관리 관련 법률의 문제점 및 개선방안에 관한 연구

초록
19세기 말 내지 20세기 초경 근대적 의미의 항만관리제도가 생겨나면서 점차 항만과 항만관리에 대한 관심이 높아짐에 따라 주요 해운국들은 자국의 항만을 적극 개발하기 시작하였고, 항만관리가 하나의 연구대상이 되면서 기존 항만에 대한 관리 제도를 개선하는 등 항만경쟁력 강화를 위하여 보다 합리적이고 효율적인 항만관리방안을 모색하기 시작하였다. 세계 각국들은 지역별 물류중심 국가로서의 주도권을 확보하기 위해 각 국가의 항만 특성에 맞는 항만관리 및 운영제도를 시행해 오고 있다. 특히 이른바 오늘날 물류중심 국가들은 항만 물동량을 높이기 위한 방법으로 항만 시설의 개발 보다는 현재 개발된 항만시설들을 효율적으로 활용하기 위한 방향으로 항만정책을 추진하는 등 종래 공급 중심의 하드웨어적 항만개발 정책에서 관리·운영 중심으로 인식이 전환되고 있기 때문에 항만관리제도는 항만경쟁력을 강화하는 중요한 요소 중의 하나라고 할 수 있다. 오늘날 대내·외적으로 어려움을 겪고 있는 우리나라 항만의 경쟁력을 강화하기 위해서는 항만관리·운영에 관한 법제도를 개선하여 항만운영의 효율성을 제고하는 노력이 무엇보다도 필요한 시점이다. 본 논문에서는 항만관리제도의 유형과 각 유형별 항만관리제도의 장·단점을 살펴보고, 우리나라 항만관리 관련된 핵심 법률이라고 할 수 있는 항만법과 항만공사법을 중심으로 당해 법률의 문제점을 분석하고, 이에 대한 개선방안을 제시하고자 한다.
Abstract
The end of 19C or the beginning of 20C, as the main carrier nations have been interested in port and port management since the modernistic port management system was occurred. They have started not only developing their new port but also being interested in port management system. Therefore, port management system has been object of study in order to enhance and seek effective port management plan. Moreover, all of the countries which are pursuing of Port & Logistics are carrying out the characteristic port management system by themselves for building up the substantial lead in Port & Logistics. Specially, as nowadays the central logistics countries are interested in port management more than the port development, they focus port management and operation on using port facilities. Therefore, Port management system is one of the most important factors to enhance their port competitive power. In this paper, to enhance port competitive power which is trouble it's time to effort of improving efficiency through out the upgrading the related Act and improving of port management and operation system. This paper analyses points of problems on the Port Act and Port Authority Act and suggests those improvement.
