≪大典會通≫ 刑典 규정의 成立沿革

In this paper, I study how new criminal articles were stipulated in Daejeonhoetong (大典會通). Previous studies claim that royal edicts after Daejeontongpyeon (大典通編) were complied into Daejeonhoetong (大典會通), but this paper shows that royal edicts before Daejeontongpyeon (大典通編) were also included in Daejeonhoetong (大典會通). Most of the new criminal articles in Daejeonhoetong (大典會通) were based upon royal edicts during the Jeongjo (正祖) rule, while a small number of royal edicts were issued by his successors, such as Sunjo (純祖), Heonjong (憲宗),and Cheoljong (哲宗). Because the abstract criminal articles in Daejeonhoetong (大典會通) were stipulated by compiling concrete royal edicts, it is impossible to understand them without knowing the original contents of royal edicts. In many cases, we fail in comprehending the contextual meaning of articles by literal interpretation of them. Though this study does not give the entire picture of the establishment of new criminal articles in Daejeonhoetong (大典會通), it provides a glimpse of how we can understand them completely through royal edicts newly found, Seungjeongwonilgi (承政院日記), Bibyeonsadeungrok (備邊司謄錄), and so forth. It also provides foundation for studying aspects and countermeasures of crimes in the late 18th and the early 19th century reflected on the criminal articles in Daejeonhoetong (大典會通).
